Baddesley Clinton, Woodloes and Woodcote

Description

Settlement made between Nicholas Brome of co. Warwyk' esq. and Thomas Marowe of London gent. previous to the marriage of the said Thomas and Isabel eldest daughter of the said Nicholas which was to take place before the following Easter. The said Nicholas was to grant lands of the annual value of £20, of which £10 was to come from lands outside Warwick, to the said Thomas and Isabel and their lawful heirs before Christmas 1492, and whereas John Beaufitz, John Archer and Thomas Ryton were seised of the manor of Baddesley Clynton' and appurtenances in co. Warwick and enfeoffed the same to the said Nicholas, Elizabeth his wife and their lawful issue, who in turn enfeoffed Master John Arondell' and Edmund Stradlyng, to hold to the use of the said Nicholas and Elizabeth and their lawful heirs, or in default to the assigns of the said Nicholas, it was assumed that this feoffment applied to other lands of the said Nicholas in co. Warwick. The said parties therefore agreed that if the said Elizabeth died before the said Nicholas and the said Nicholas married again, the said Master John Arondell' and Edmund Stradlyng should stand seised of the manor of Woodloes and Wodcot, together with such other lands of the said Nicholas in co. Warwick so that the said manor should be equal in yearly value to the manor of Baddesley Clynton, to the use of the said Nicholas and any future wife for their lives, then to the said male heirs of the said Nicholas, then to the heirs of the said Nicholas by the said Elizabeth and then to the assigns of the said Nicholas. However if the said feoffment to Master John Arondell' and Edmund Stradlyng only applied to the manor of Baddesley Clynton, then the said Nicholas with the advice of the said Thomas undertook to make a feoffment to Sir Richard Hawght' knt., Richard Hall, John Denton', Robert Throgmerton', Edward Belknap', John Harewell', Andrew Wyndsoer, John Archer, Richard Higham, Thomas Essex, Thomas Frowyk', John Bardfeld', Robert Brudenell', Hugh Shirley, Edward Rawley the younger, Edward Greneild', Thomas Denton', John Archer the younger, John Clopton the younger son of William Clopton and Richard Throgmerton' gents. of the said lands to hold for the said uses. If the said Nicholas died without male heirs the said lands of the annual value of £20 were to pass to the said Thomas and Isabel and lands of worth £20 more were to pass to her sisters as their marriage portion. The said Thomas agreed to make an estate to the said feoffees before Christmas 1492 of the annual value of 50 marks, or else to make an estate of £20 and for the remaining 20 marks to pay 350 marks to the Abbot of Kenelworth, the Prior of Coventre or the Abbot of Bordesley or the Prior of Mastok to purchase an estate of the annual value of 20 marks within three years and convey it to the said feoffees. If the said Isabel died and the said Thomas married again, the said feoffees were to stand seised of lands of the annual value of £20, part of the lands worth 50 marks, to the use of the said Thomas and his then wife, then to his male heirs, then to his heirs and then to his assigns, and also to stand seised of remaining lands of the annual value of 20 marks after the death of the said Isabel to the use of the said Thomas and his male heirs, then to his heirs and then to his assigns. The said Thomas also agreed to make an estate to the said feoffees of lands to the further annual value if 25 marks to be held to the same uses, with provision that if the said Isabel died without male issue by the said Thomas, the said clause relating to the additional 25 marks was to be void, and if the said Isabel died without any issue by the said Thomas, then the said feoffees were to hold all the lands of the said Thomas to perform his will. The said Nicholas and Thomas then agreed to be mutually bound to each other in the penal sum of £1000 to perform the said settlement. 8 January 6 Henry VII [1490/1]. Tag for seal.
