Copy of a codicil dated 16 July, 27 Henry VIII [1535] to the will of Sir David Owen, knight, desiring that his estates should be governed by conditions set out in a pair of indentures bearing even date with this codicil, made between him and Sir Thomas Audeley, knight, Lord Chancellor of England and Sir William FitzWilliam, knight, Treasurer of the King's household, (whom he has named as two of his executors) namely, that those in possession of the manor of Southwike, co. Wilts., and the chantry there, the manor of Wotton, co. Surrey, with the advowson of the church and the free chapel there, his lands in Rousper [Rusper] and Horsham and his lands called the Rode Lands, co. Sussex, and his lands in Ferthingston, Hallawell [Hollowell] and Erneleley [Evenley], co. Northants., shall hold the same to the use of the said Sir David Owen for life, then to the use of his son Henry Owen by Anne, his wife, and of his heirs male, or in default to the use of John Owen, his second son and his heirs male, or in default, to the use of his son Jasper Owen and his heirs male, or in default to the use of David Owen, the son of his son Henry Owen, and his heirs male; similarly, those now in possession of the manors of Welton and Buckby, half the manor of Creeke [Crick] late belonging to William Catesbie and a toft with a close and nine acres in Creeke, late belonging to John Holcote, the manor of Moche Creton [Creator], alias Watfordes Manor in Moche Creton, and two messuages, four and a half yardlands, two closes of pasture and ten acres of wood in Moche Creton and Litle Creton, co. Northants., and the manor of Weston Corbett, co. Hants., shall hold the same after the death of the said Sir David Owen and his wife Anne, to the use of the said Henry Owen and his heirs male, with reversion in default to the said John Owen, the said David Owen and the said Jasper Owen; similarly, those now in the possession of the manors of Lagham, Walkeshampsted and Merden and all his messuages and lands in Lagham, Walkeshampsted [Walkingstead], Codston and Merden, co. Surrey, and the manor of Bodington and all his messuages and lands in Bodington, Esseborne [Easebourne], Lynchemere and Farnehurst [Fernhurst], co. Sussex, shall hold the same to the use of the said Sir David Owen and Anne his wife and their heirs; those now in possession of the manor of Watforde, co. Northants., and all his messuages and lands in Watforde and Borysworth [Bosworth], co. Leics., shall hold the same to the use of the said Sir David Owen, and after his death to the use of William Owen, his bastard son and his heirs male, or in default to the use of the said Henry Owen and his heirs male; those now in possession of the manor of Oxhulfe [Oxhill] with the advowson of the church, and all his other messuages and lands in Oxhulfe, Gaydon, Pryors Hardewike, Napton, Chepinge Dorsett [Burton Dassett] and Corley, co. Warws., and the manor of Isampsted Latymer [Latimer], co. Bucks., shall hold the same to the use of Sir David Owen for life, then to the use of the said John Owen and his heirs male, or in default to the use of the said Henry Owen and his heirs male; those now in possession of the manor of Woulde [Wold] and all his messuages and lands in Wolde and Shetlanger [Shutlanger], co. Northants., and all his messuages and lands in Donton, co. Leics., and in the city of Coventrye, shall hold the same to the use of the said Sir David Owen for life, then to the use of the said Jasper Owen and his heirs male, or in default to the use of the said John Owen and his heirs male, or in default to the use of the said David Owen, son of the said Henry Owen. Note at head that this deed is an extract from the last will of Sir David Owen, dated 20 February 1529/30.
