Description

Copy of an assignment of three mortgages, totalling 5000 pounds, and an interest in four legacies totalling 4000 pounds, charged on the estate of Francis Gregory of Stivichall, esq. in Stivichall, comprising the following transactions: i) An assignment from John Alldritt of Castle Bromwich, gent., Rev. William Bowen of Swansea, co. Glam., clerk, and Lucy his wife, Arthur Thomas Gregory of Stivichall, Lieutenant R.N., and the said Francis Gregory to Thomas Edwards of Alford, co. Cheshire, clerk, James Montgomery of Old Brentford, co. Middx., timber-merchant, and Thomas Berry Rowe of the same, soap manufacturer, for 1000 pounds apiece, of all their interest in four 1000 pound leg agrave;cies to which they were entitled under the will of Arthur Gregory, esq., deceased, [no. 953], John Alldritt being the administrator of the goods of his late wife Frances Alldritt, formerly Frances Gregory (died May 1815) who, as one of the four daughters of the said Arthur Gregory had been entitled to her legacy on marriage; Rev. William Bowen having married Lucy Morgan, widow, formerly Lucy Gregory, who, as another of the four daughters of the said Arthur Gregory, had been entitled to her legacy on her first marriage with Benjamin James (died 1823); Arthur Thomas Gregory being one of the younger sons of the said Arthur Gregory who had been entitled to his legacy on coming of age; and Francis Gregory being the surviving executor (the other executor William Wade, clerk, having died 21 January 1823) of the will of Arthur Robert Gregory (died 21 July 1796), who, as another of the younger sons of the said Arthur Gregory, had been entitled to his legacy on coming of age. These assignments were made with the consent of the said Francis Gregory, and of Thomas Coulson Carpenter of Lyme, co. Dorset, doctor of physic, Thomas Bonnor, late of Spring Gardens, Westminster, and now of Lindsay Place, Chelsea, co. Middx., esq., and James Wittil Lyon of Great Russel Street, Bloomsbury, co. Middx., gent., the executors of the will of Maria Anne Powell, deceased (dated 20 November 1815, with a codicil of 1817, and proved 21 August 1819) who was the executrix of the will of Henry Watson Powell (dated 26 August 1813, proved 1 September 1814), he in turn being the surviving trustee of the will of the said Arthur Gregory (the other trustee, Charles Wallott Willers having previously died and having appointed the said Henry Watson Powell his executor of the trusts contained in the will). ii) Assignment, for 5000 pounds paid by the said Thomas Edwards, James Montgomery and James Berry Rowe to George Grote of Threadneedle Street, London, banker, and Charles Stirling, Admiral R.N., of three mortgages: a) a mortgage of 29 and 30 March 1790 from Arthur Gregory to Thomas Birch of property in Stivichall to secure 1000 pounds [no. 951], which mortgage was assigned by the said Thomas Birch to George Grote on 2 August 1793, from George Grote to John Remington, esq., on 15 March 1794, and from John Remington to Joseph Grote, George Grote and Charles Stirling on 26 March 1810; to which mortgage was added, on 26 September 1810, a further charge from the said Francis Gregory to the said Joseph Grote, George Grote and Charles Stirling of 2000 pounds, required by the said Francis Gregory to reimburse him for the discharge of legacies under the will of the said Arthur Gregory of 1000 pounds apiece to Ann Gregory,one of the daughters of the said Arthur Gregory on her marriage with Benjamin James, since deceased, and to Mary Gregory, another of the said daughters, on her coming of age; and at the same time the said Henry Watson Powell, trustee of the said will of Arthur Gregory for a term of 500 years, assigned his interest in the mortgaged property for the remainder of this term to William Willoughby Prescott of Threadneedle Street, banker, and Thomas Lane, gent., in trust for the said Joseph Grote, George Grote and Charles Stirling; and now the said William Willoughby Prescott (Thomas Lane having died on 15 November 1822, leaving the said William Willoughby Prescott his executor) at the request of the said George Grote and Charles Stirling (the said Joseph Grote having died on 24 May 1814, leaving the said George Grote and Charles Stirling his executors) and of the said Francis Gregory, eldest son and heir of the said Arthur Gregory, and in consideration of part of the said 5000 pounds paid by the said Thomas Edwards, James Montgomery and Thomas Berry Rowe to the said Charles Grote and Charles Stirling, assigns his interest in the mortgaged property to Hugh Clarke Ronalds of Old Brentford, co. Middx., nurseryman, to hold for the residue of the term of 500 years in trust for the said Thomas Edwards, James Montgomery and Thomas Berry Rowe. b) a mortgage of 25 and 26 April 1765, from the said Arthur Gregory to Edmund Crynes, doctor of physic, of a messuage and farm of sixty acres, late in the tenure of Abraham Dry and then of ----- Dry, widow, a messuage and farm of fifty-two acres late in the tenure of Francis Ebourne and then of ------, a messuage and farm of twenty-four acres late in the tenure of Widow Roads, a messuage and farm of forty-eight acres late in the tenure of William Woods and then of John Hewitt, a messuage,mill and farm of forty acres late in the tenure of Sharman Lovett, and a messuage and farm called Nether Field Farm and Stivichall meadow, containing one hundred acres late in the tenure of the said Arthur Gregory and then of ------, all of which property was situated in Stivichall, together with the mansion house and its appurtenances and five closes behind the same containing sixty acres in the occupation of the said Arthur Gregory, to secure 1000 pounds; which mortgage was assigned by the said Edmund Crynes to William Holbech and John Blencowe on 21 November 1767, from Ann Bree (formerly Ann Blencowe), widow of Thomas Bree, clerk, one of the co-heirs of the said John Blencowe, and Samuel Jackson, alias Blencowe, esq., the other coheir of the said John Blencowe and his executor (John Blencowe having outlived the said William Holbech) to John Remington, on 15 March 1794, and from John Remington to Joseph Grote, George Grote and Charles Stirling on 26 March 1810; and now the said George Grote and Charles Stirling (Joseph Grote having since died), at the request of the said Francis Gregory, eldest son and heir of the said Arthur Gregory, in consideration of part of the 5000 pounds paid to them, assign to the said Thomas Edwards, James Montgomery and Thomas Berry Rowe the said mortgaged property. b) a mortgage of 30 September 1769, from the said Arthur Gregory to Thomas Ward, gent., of the rectory of Stivichall, alias Stichall, and the churchyard, a messuage adjacent to the churchyard in the tenure of Elizabeth Cox, widow, with the tithes issuing from a close called Shoulder of Mutton Close or Sword Bearer's Piece, and a meadow called the Holmes; also the advowson of the church of Stivichall, a newly erected messuage with the newly enclosed lands containing one hundred and nine acres in Park Field then in the tenure of William Howe, at an annual rent of 80 pounds, under a lease from Edward Bowater to the said William Howe, dated 25 August 1760; all which lands were situated in Stivichall and were awarded to Bridget Bowater, mother of the said Edward Bowater, at the time of the enclosure of the common fields of Stivichall; to hold for 1000 years at a pepper-corn rent to secure 1000 pounds; which mortgage was assigned from the said Thomas Ward to Edward Davis, baker, on 29 September 1775, from the said Edward Davis to James Jones, merchant, on 28 July 1781, from the said James Jones to John Remington on 15 March 1794, and from John Remington to Joseph Grote, George Grote and Charles Stirling on 26 March, 1810; and now the said mortgage is assigned as before, to hold for the residue of the term of 1000 years. Redemption of all the above property on the payment of 9000 pounds by the said Francis Gregory to the said Thomas Edwards, James Montgomery and Thomas Berry Rowe. Schedule attached of all the above mortgaged farms with names of present occupiers and rentals.
