Attested copy deed of partition of the estates of the [2nd] Lord Archer in the counties of Warwick, Gloucester and Worcester, being an indenture of six parts between 1. the Rt. Hon. Other Archer [6th] earl of Plymouth, 2. Henry Howard of Corby Castle, co. Cumberland esq., the most noble Charles duke of Norfolk, hereditary earl marshal of England, and Charles Chaplin of Blankney co. Lincs. esq. (which said Charles duke of Norfolk and Charles Chaplin survived Other Hickman [5th] earl of Plymouth their co-trustee in the marriage settlement of the said Henry Howard and the Hon. Maria Howard his wife, late Maria Archer spinster and then deceased), 3. the Rt. Hon. William Pitt, Lord Amherst and the Rt. Hon. Sarah Lady Amherst, theretofore the Hon. Sarah Archer spinster and late Sarah, dowager countess of Plymouth, the Rt. Hon. John, Lord Boringdon, Edward Hale Adderley of Innishannon near Bandon in Ireland esq., Edward Bolton Clive of Whitfield Lodge co. Herefore esq. and William Champion de Crespigny of Kings Row co. Hants. esq. but lately called William Champion Crespigny (which last four were trustees of the marriage settlement of the said William Pitt, Lord Amherst and Sarah Lady Amherst his wife), 4. Christopher Musgrave of Somerset Street, Portman Square co. Middx. esq. and the Hon. Ann Elizabeth his wife, formerly Ann Elizabeth Archer spinster, and the Hon. Thomas Windsor of St. Goerge's, Hanover Square, same co. (who survived the said 5th earl of Plymouth and who also survived Joseph Musgrave late of New Norfolk Street, co. Middx. esq. and John Chardin Musgrave of Hampton Park same co. esq., afterwards Sir John Chardin Musgrave, his co-trustees of the marriage settlement of the said Christopher Musgrave and Ann Elizabeth his wife), 5. the said Edward Bolton Clive and the Hon. Harriet his wife, and the Rt. Hon. Edward earl of Powis, who survived the said 5th earl of Plymouth his co-trustee of the marriage settlement of the said Edward Bolton Clive and Harriet his wife, and 6. William Ryder of Lincolns Inn co. Middx. gent. The recitals included the following: (1) the death of Andrew [2nd] Lord Archer on 28 February 1778, intestate, leaving Sarah Lady Archer his widow and four infant daughters his co-heirs at law viz. the said Sarah Lady Amherst, the said Ann Elizabeth Musgrave, the said Maria Howard and the said Harriet Clive; (2) the marriage settlement of the said Andrew Lord Archer and Sarah Lady Archer his wife, then Sarah West spinster, dated 17-18 July 1761; (3) the marriage settlement of Other Hickman [5th] earl of Plymouth and Sarah Archer dated 19-20 May 1788; (4) the marriage settlement of Henry Howard and Maria Archer dated 18-19 November 1788; (5) the death of Maria Howard on 9 November 1789; (6) the marriage settlement of Christopher Musgrave and Ann Elizabeth Archer dated 3-4 October 1790; (7) the marriage settlement of Edward Bolton Clive and Harriet Archer dated 3-4 December 1790; (8) the sale of the manors and estates of the late Andrew Lord Archer in Essex in 1791, and distribution of the proceeds (including one fourth part advanced on mortgage of divers estates of Philip Howard esq. father of the said Henry Howard in Cumberland in 1792); (9) the death of Other Hickman [5th] earl of Plymouth on 12 June 1799, leaving his widow Sarah later Lady Amherst and Other Archer then [6th] earl of Plymouth his only surviving son and heir at law, having made his will dated 26 May 1797 and codicil dated 13 July 1798; (10) the marriage settlement of William Pitt, Lord Amherst and Sarah countess of Plymouth dated 22-23 July 1800; (11) articles of agreement dated 27 July 1811 providing for Henry Howard to release his life interest in his late wife Maria Howard's fourth part of the estate of the late Andrew Lord Archer, and for Other Archer [6th] earl of Plymouth to acquire Sarah Lady Amherst's third part of her late sister Maria Howard's fourth part of the same, and for a partition into three equal parts of all the late Andrew Lord Archer's real estates remaining unsold, the allocation of such parts to be made by lot, each of the parties to contribute one third share of an annuity of £800 to be paid to Henry Howard for life; (12) appointment of Francis Webb of Salisbury co. Wilts. esq. to survey, value and partition into three equal parts the estates of the said Andrew Lord Archer in cos. Warwick, Gloucester and Worcester; (13) certificate of the said Francis Webb dated 3 July 1812 that in his opinion one third part of one undivided fourth part of the estate (to which the said Lord and Lady Amherst were entitled), excepting the advowson of Solihull and certain other exceptions, was worth £29,962.5s.6d. and that he had made a division of all the estates, with the same exceptions, into three lots distinguished by the letters A, B and C; (14) that lots were drawn, but lots B and C subsequently exchanged by agreement, so that lot B fell to Other Archer earl of Plymouth, lot C to Christopher Musgrave and Ann Elizabeth his wife and lot A to Edward Bolton Clive and Harriet his wife; (15) that it was agreed that the advowson of Solihull and other properties excepted from the partition should be disposed of, and that a special arrangement should be made for partitioning the tithes belonging to the impropriate rectory of Tanworth. Consideration money comprised sums of £125 paid by Other Archer earl of Plymouth to Christopher Musgrave, and £3,165.10s.6d. to Henry Howard and £26,671.15s.Od. to the trustees of Lord and Lady Amherst (making together the sum of £29,962.5s.6d. as above specified); also £375 paid to Christopher Musgrave by the said Earl of Plymouth and £500 by each of the other two partitioners (making together with the £125 above, £1,500 to Christopher Musgrave for principal money due to him); and £3,165.10.6d. paid to Henry Howard by Christopher Musgrave and Ann Elizabeth his wife and £3,165.10s.5d. by Edward Bolton Clive and Harriet his wife (making together with the £3,165.10s.6d. paid by the earl of Plymouth the agreed sum of £9,496.11s.5d. for his releasing his life interest in the estate). It was then witnessed in consideration of the above that the principals and their trustees, after revoking former uses of the subsisting marriage settlements in respect of these estates, conveyed to the said William Ryder the manors of Tanworth, Umberslade, Monkspath, Fullwood and Codborough, the capital messuage of Umberslade Hall, Umberslade Park and parcels adjoining (named) and all the demesne lands of Umberslade in the towns, hamlets or vills of Umberslade, Tanworth, Nuthurst and Ullenhall and parishes of Tanworth or Wootton Wawen, the manors of Solihull, Botley, Henley, Claverdon and Birmingham, the rectory and advowson of Tanworth, advowson of Solihull, fairs held in Henley and Solihull, and messuages and lands (specified) in Tanworth, Nuthurst, Solihull, Wootton Wawen, Beaudesert, Henley, Ullenhall, Aston Cantlow, Packwood, Warwick and Claverdon co. Warwick, Clifford co. Glos. and Alvechurch co. Worcs., all which said manors, messuages and lands were divided according to the survey and division of Francis Webb into three lots comprised as follows: Lot B comprised the manor of Solihull, advowson of Tanworth, messuages and lands (specified) in the West division of Tanworth amounting to 1739 acres, and the rectory of Tanworth (except certain tithes allotted to lots C and A); Lot C comprised the manor of Claverdon and messuages and lands (specified) in Claverdon and Rowington amounting to 1333 acres, the manors of Botley, Henley and Birmingham and messuages and lands (specified) in Solihull, Aston Cantlow, Packwood, Henley, Beaudesert and Tanworth, and in Clifford co. Glos. and Alvechurch co. Worcs., and tithes of Tanworth arising from lands in the North division containing 1619 acres and described in the second schedule; and Lot A comprised the manors of Tanworth, Umberslade, Monkspath, Fullwood and Codborough, the capital messuage of Umberslade Hall, messuages and lands (specified) in the East division of Tanworth and in Nuthurst, Ullenhall and Beaudesert amounting to 1752 acres, and tithes arising on 1429 acres of land in the East division of Tanworth as described in the third schedule, to hold to the said William Ryder to uses and upon trusts duly specified, each lot being charged with the payment of one third of the annual sum of £800 payable to Henry Howard for life, and the properties excluded from the partition viz. the advowson of Solihull, a messuage in Warwick and 14 acres of land in Solihull to be disposed of and the proceeds divided as specified, with covenant to levy a fine or fines and other covenants. Witnesses: Thos. Ryder, Wm. Ades, Carew Thos. Elers, Jas. Hartin, F. Carr, Jas. T. Reed, Henry Allen. Examined with the original, 5 September 1825, and certified a true copy by C. Wheeler and Wm. Drew. Memorandum endorsed that by lease and release dated 18-19 July 1825, Edward earl of Powis at the request of Edward Bolton Clive conveyed to Robert Knight esq. lands and hereditaments in Ullenhall and Beaudesert, part of lot A (above), containing 140 acres 2 roods 2 perches with a right of way through Georges meadow, B[ ] hill and Back hill. Note. This purchase included Hall End farm. Nos. 15 16 enclosed in a parchment cover endorsed: Attested copies of two deeds relating to estates in Ullenhall and Beaudesert purchased by Robert Knight esq. in fee of E.B. Clive esq. These estates were sold by Mr. Knight to the uses of the will of the earl of Catherlough decd., 22-23 July 1836. [Purchase No. 26]
