The College and Rylands Close, Stratford-upon-Avon

Description

Settlement by lease and release being a conveyance from Edmund Battersbee of Stratford-upon-Avon, esquire, to Henry Farrington of Manchester, merchant, and the Revd. Edward Vernon of Chester, of certain freehold and leasehold properties, namely, a mansion house and garden belonging thereto late in the tenure of Mrs. Sarah Lane and since of Charles Henry Hunt, and which said messuage was late the estate of Bartlett Mason, gentleman, afterwards of Thomas Mason, esquire, Lucy Hardy and lately of Rean Corbett, gentleman, in Stratford-upon-Avon, the College together with its gardens and orchard, late in the tenure of James Kendall and since of John Fullerton, a piece of land whereon a barn lately stood, also Sheffield (now Dog Kennel) Close, Sandhill or Santhill Close (now Lady Meadow) formerly in the separate tenure of John Taylor and Mark Noble, a piece of land whereon a messuage once stood adjoining the Tithe or College Barns, the Bowling Alley, formerly a cherry orchard, Ryland's Close, formerly in the possession of Thomas Knight and afterwards of Jane Bradley, a parcel of land in Church Street now part of the College gardens, and another parcel of land in Chapel Street also now part of the College Gardens, and the land on which formerly stood the Tithe Barn at the lower end of Church Street, now walled in and part of the gardens of the said College, all in Old Stratford; to hold in trust to sell or mortgage the same at the request of the said Edmund Battersbee and to stand possessed of the money so raised for the uses declared in DR123/28 and until that time to hold the property in trust for Edmund Battersbee and from its revenue provide an annuity of £400 for his wife Sophie in the event of his death. The release contains the following recitals: (a) Conveyance by lease and release of 28 and 29 September 1794 from Charles Henry Hunt, esquire of Stratford-upon-Avon, and his wife, Elizabeth Ann, to Edmund Battersbee and Thomas Sandford of a mansion house in Stratford-upon-Avon, (b) DR123/24 and 25, (c) DR123/9 and 10 (d) lease, dated 15 July 1747, from Francis Lord Conway, Baron of Ragley, to James Kendall of Hanover Square, of a parcel of land in Church Street for 99 years at the annual rent of 2s. 6d. and an indenture dated 14 September 1796, assigning the property to Edmund Battersbee for the residue of the said term (e) lease, dated 25 February 1803 from the Mayor, Aldermen and Burgesses of Stratford-upon-Avon to Edmund Battersbee of a parcel of land in Chapel Street on a 99 year lease at the annual rent of 13s. 4d. and 2 capons or 1s.6d. in lieu thereof (f) lease, dated as for (e) above, from the Mayor, Aldermen and Burgesses of Stratford-upon-Avon to Edmund Battersbee of the land at the lower end of Church Street on which formerly stood the Tithe Barn, on a 99 year lease at the annual rent of 2 shillings and 2 capons or 1s.6d. in lieu thereof.
