By his will, testator vested his estates in trustees John Ballard, Birmingham, pumpmaker and William Pitt, Birmingham, japanner, for various trusts to be operative after the death of his widow Sarah (who died 1837). By death and deeds of assignment the trust estates are vested in Thomas Harman, Henry Jones Dollman and Charles Dollman who were not appointed trustees of the will of William Ballard, nor was there any power of appointment of trustees contained in the will. Plaintiffs and remainder of defendants are residuary legatees (or their heirs) of the will and plaintiffs wish Chancery to appoint trustees to fulfill trusts contained in the will [recited in detail].
