Lease and Release: Nollands and Sidenalls, Honington

Indentures of Lease and Release between Edward Gibbs of Honington, esq. (Cornet in H.M. Regiment of Horse commanded by the Honourable Field Marshall Wade) and Agnes his wife (eldest daughter of Sir William Keyt late of Upper Norton, co. Glos., Bart., deceased, and the Honourable Dame Ann Keyt his wife) of the first part, Sir Thomas Charles Keyt of Upper Norton, Bart., and John Clopton of Stratford-upon-Avon, esq., of the second part and Samuel Tyler of Shottery, esq., and Stephen Burman of Shottery, gent., of the third part, whereby Edward Gibbs, in consideration of the marriage then had between him and Agnes his wife and of the sum of £2,666 13s 4d received by him as the marriage portion of his said wife (which sum the said Agnes was entitled to under the marriage settlement of Sir William Keyt and Dame Ann his wife as one of the younger children of the said Sir William Keyt and Dame Ann), conveyed the premises described in ER3/2087 to Sir Thomas Charles Keyt and John Clopton and their heirs; as to and concerning premises called the Furze Nollands, to the use of Edward Gibbs for life, with remainder to Sir Thomas Charles Keyt to preserve contingent remainders during the life of Edward Gibbs, with remainder to the use of Agnes, wife of Edward Gibbs, for life, with remainder to Samuel Tyler and Stephen Burman for a term of 500 years to raise £2,000 for portions for the younger children of the marriage, with remainder to the use of the first and other sons successively in tail male, with remainder to the use of Thomas Gibbs (brother of Edward Gibbs) in tail male, with remainder to the use of the right heirs of Edward Gibbs; and as to and concerning the other part of the premises, to the use of Edward Gibbs for life, with remainder to Sir Thomas Charles Keyt and John Clopton in trust to preserve contingent remainders and thereafter to Samuel Tyler and Stephen Burman for a term of 500 years to raise £2,000 as portions for the younger children of the marriage, with remainders as above. Power reserved in the said settlement for the said Edward Gibbs and Agnes his wife to revoke or alter any of the above trusts and uses during their joint lives. Witnesses: Richard Wright, Joshua Harbourne, Samuel Welshman and John Hill. With attested copies.
