Description

Early 16th century copy of the settlement made between Henry Ferrers knt. and Edward Ferrers son and heir of the said Henry Ferrers of the first part, Nicholas Brome of Baddeslye esq. of the second part, and Thomas Marrowe of London gent. of the third part, previous to the marriage of the said Edward Ferrers and Constance the younger daughter of the said Nicholas, which marriage was to take place before the following Lady Day. The said parties agreed that the said Henry and Edward should convey to the said Edward and Constance, Robert Throckmorton. Richard Hall, Thomas Denton and Thomas Whitendon for the term of the life of the said Constance the manor of Hamyld [Hambleton] co. Rutland with remainder to the said Edward and his lawful heirs, or in default of such issue to the rightful heirs of the said Henry, provision being made that if the said Edward died during the lifetime of the said Henry, the said Henry should receive the profits from the said manor for the term of his life, excepting 40 marks to be paid annually to the said Constance. The said parties also agreed that whereas Isabella the elder daughter of the said Nicholas had married the said Thomas Marrowe and had received from the said Nicholas lands of the yearly value of £20, and the said Nicholas had enfeoffed the residue of his estate to Richard Hiham, Thomas Frowyk, serjeants-at-law, Robert Throckmorton, Edward Belknappe, John Harwell, Andrew Windsore, John Archer, Thomas Essex, Robert Brudwell, Hugh Shirley, Edward Rawley the younger, Edward Sriwell, Thomas Denton, John Archer the younger, John Clopton son of William Clapton, together with John Denton and John Beryfelde now deceased, that the said Nicholas should cause the said feoffees to make estate of his manor of Lapworth alias Bromes, and of a capital messuage called Bromesplace lying in Crosse street in Warwick, another tenement in the same street in the tenure of William Hoo, a tenement in the tenure of Richard Clarke, a croft, in the same street in the tenure of Richard Robins, two tenements lying together at the corner of the same street in the tenure of John Brome, a croft in the same street in the tenure of Samuel Byfeldes, a barn in the same street in the tenure of Thomas Bests, a croft in Smith street in the tenure of William Aleyne, a garden in St. Nicholas street in the tenure of John Carneste, a tenement in the Highe Paiment in the tenure of John Man, a tenement in the Bucherey in the tenure of John Kendall, a garden in the Ware street in the tenure of Richard Stone, two crofts in le Myton in the tenure of Richard Carpenter, 2 acres of meadow in the Hasewell in the tenure of Thomas Edom, a tenement in Northgate street in the tenure of Richard Tussingham, a garden in West Street in the tenure of William Smith, a tenement in the same street in the tenure of Ralph Sterkey, part of a tenement in Hatton, a croft in le Olde, an acre of land in Hatton field with 10 selions of land in Hamton field, a close in the same field called Bapter close in the tenure of Steven Fisher, and a tenement in le Jurye in the tenure of Roger Fisher, to the said Edward and Constance, to hold the same from the chief lords of the fee for due and customary service. The said parties also agreed that the said feoffees should stand seised of all the residue of the said lands, excepting the manor of Baddely Clynton, the lands granted to the said Isabella and Thomas and the lands granted to the said Constance and Edward, to the use of the said Nicholas and his lawful male issue, with provision that if the said Nicholas should die during the lifetime of Elizabeth his wife, the said feoffees should stand seised of the said manor of Baddesley for the use of the said Elizabeth during her life, but that if the said Nicholas should die leaving any other wife, ten the said feoffees were to stand seised of the manors of Woodloe, Ouerwoodcote and Netherwoodcote, to the use of the said other wife during her life. However if the said Nicholas died without lawful male issue then the said feoffes were to stand seised of the manor of Baddesley Clynton, a tenement in Offchurche and lands there in the occupation of Richard Stanly, lands in Bowsale in the occupation of Thomas Coper, 6d. free rent paid yearly by the Wardens of the church of St. Nicholas in Warwick, and a barn and divers lands in the occupation of John Lee, to the use of the said Isabella and her lawful issue, or in default of such issue to the use of the said Constance and her lawful issue, or in default to the rightful heirs of the said Nicholas, and the said feoffees were to stand seised of the said manors of Woodloe, Ouerwoodcote, Netherwoodcote, together with a tenement and meadow in Estrope [Eathorpe] in the occupation of William Westeley, 14d. chief rent of the Gild of Warwick, a tenement in Warwick in the occupation of Thomas Comaunder, and a barn and other lands in the occupation of Edward Darbye, to the use of the said Constance and her lawful issue, or in default of such issue to the use of the said Isabella and her lawful issue, or in default to the right heirs of the said Nicholas, and it was agreed that if the said Nicholas died without lawful male issue during the lifetime of the said Elizabeth his wife, that then the said Constance should pay yearly during the life of the said Elizabeth to the said Isabella or her heirs out of the manors of Woodloe, Ouerwoodcote and Netherwoodcote as much rent as was equal to the moiety of the manor of Baddesley Clynton, and that if the said Nicholas died without lawful male issue leaving any other wife that then the said Isabella should pay yearly during the life of the said other wife to the said Constance and her heirs as much rent as was equal to the moiety of the manors of Woodloe, Ouerwoodcote and Netherwoodcote. The said parties also agreed that if the said Nicholas died leaving lawful male issue that then the said feoffees should stand seised of the manor of Baddesley Clinton to the use of the said Isabella and her lawful issue for 7 years after the death of the said Nicholas and Elizabeth, or the longer liver of them, and that during this term the said Isabella should pay the said Constance a yearly rent equal in value to the moiety of the said manor while any male heirs of the said Nicholas were alive, or else to purchase for the said Constance lands of a yearly value equal to the said moiety in any of the counties of Warwick, Leicester, Stafford, Rutland, Northampton, Sussex, Surrey or Kent, not being of the tenure or nature of `gavelkynde'[gavelkind], and when such purchase was completed the said annual rent should cease, and the said feoffees should stand seised of the whole manor of Baddesley to the use of the said Isabella and her heirs. The said parties also agreed that any terms of an agreement made between the said Nicholas and Thomas Marrowe, not in accord with this present agreement should be null and void, and the said Henry Ferrers agreed with the said Nicholas that he would not put away or set any manors or lands which ought according to the right of law or conscience descend to the said Edward and his heirs. 5 December 13 Henry VII [1497] Early 16th century copy of the agreement made between Sir William Powellet knt. Master of the King's Wards, and Sir Thomas Inglefeld knt. one of the King's Justices of the Common Pleas, reciting that the said Sir Thomas Inglefeld had been granted the wardship and marriage of Edward Ferrers cousin and heir to Sir Edward Ferrers knt. deceased, whereby the said Sir Thomas Inglefeld agreed to account fully to the said Sir William Powellet concerning the lands, rights and privileges now inherited by the said Edward Ferrers. 20 May 27 Henry VIII [1535].
