Agreement to Levy a Fine: Broadway, Brockhampton and Snowshill

Description

Indenture between Walter Savage of Broadway, Worcs., esquire of the first part, John Croker of Batesore, Glos., esquire of the second part, John Savage of Broadway, esquire (son and heir of Anthony Savage esquire deceased the brother of Walter Savage) and Phillippa, wife of the said John Savage, Thomas Fetyplace of Fearnham Berks., esquire and Anne, his wife, the sister of John Savage, Henry Condell of London, gentleman and William Washbourne gentleman (one of the sons of John Washbourne of Wichenford, Worcs., esquire) of the third part and Edward Sheldon of Beoley, Worcs., esquire and Samuel Burton Clerk, Archdeacon of the Diocese of Gloucester of the fourth part. Reciting an agreement dated the 12th. November 1618 between Walter Savage and John Savage concerning the partition of the Capital messuage and manor House of Broadway late in the tenure of Anthony Daston, esquire deceased, and of arable lands Demesne lands tenements meadows pastures woods etc. in Broadway also in the tenure of Anthony Daston and the tithes therein, in the tenure of Anthony Dickens also of the Manor of Brockhampton, Glos. and Snowshill in the Parish of Stanton with lands and appurtenances therein and Brockhampton Woods by which partition certain lands in Broadway (including Middle Hill were allotted to Walter Savage in severality) and the arable land in the fields of Broadway belonging to the farm of Broadway was allotted to John Croker with the consent of John Savage. It was thereby witnessed that Walter Savage of the first part, John Croker of the second part, John Savage and Phillippa, his wife, Thomas Fetyplace and Anne his wife Henry Cardell and William Washbourne of the third part in consideration of the performance of the said Articles of Agreement and of other Articles of Agreement dated 15th. July 1619 between Walter Savage of one part and John Croker and John Savage of the other part, confirmed and ratified to each other the various portions of land allotted to them by the above mentioned partition and covenanted to Levy a Fine to Edward Sheldon and Samuel Burton such Fine to enure to uses therein specified. Signed by all the persons except Samuel Burton. Seals missing. Witnesses: William Sheldon, Thomas Butcher, Ciprian Mansill, Rich Grenfield, Will Whyte, John Hales, Gyles Savage, A Daston and Anth Langston.
