Marriage Settlement: Shottery and Windsor Street, Stratford-upon-Avon

Description

Settlement on the Marrriage of John Cotterell and Elizabeth Canning, by Dorothy Cotterell of Shottery, widow of John Cotterell deceased and John Cotterell of the same place, yeoman (son of the said John Cotterell deceased and the said Dorothy) to John Smith of Bishopton, yeoman and John Canning of Upper Ettington, yeoman. Reciting ER3/3106 and that Samuel Tyler of Shottery, gentleman deceased (son of Richard Tyler) by Indenture dated the 23rd December 1671 demised to John Cotterell senior deceased a messuage with garden etc. in Shottery then in the occupation of Anne Mander, widow and a piece adjoining and used as a yard for the said messuage and then in the tenure of John Cotterell, deceased whereon a barn formerly stood also a small close in Shottery then lately enclosed being part of the said yard also in the tenure of John Cotterell, deceased and two leys with appurtenances in Shottery in a place called Cox Leys and adjoining to Sheppards Close on the North thereof all which premises the said Samuel Tyler bought [1654] of Lyonell late Earl of Middlesex for a term of 1000 years all which premises were vested in the said John Cotterell junior and Dorothy, his mother for the residue of the term of 1000 years. It was thereby witnessed that the said Dorothy and John Cotterell junior in consideration of the intended Marriage and of £120 paid to John Cotterell as the marriage portion of Elizabeth Canning of Upper Ettington, spinster (sister of the said John Canning) assigned to Henry Smith and John Canning the residue of the said terms of 1000 years in the premises described in ER3/3105 in the Rother Market, Stratford-upon-Avon described as 4 messuages with appurtenances in Hell Lane [Henley Lane/Windsor Street] near Rother Street or Rother Market with gardens etc. in the occupations of John Cowper, mason, Mary Caning, widow, Thomas Olney and Richard Moore, weaver, also and in the above mentioned premises at Shottery upon Trust to permit Dorothy Cotterell to enjoy the profits of the said messuages in Stratford-upon-Avon for her life, and to permit John Cotterell to enjoy the rents and profits of the premises at Shottery for his life, with remainder as to the premises in the Rother Market to John Cotterell if he should survive the said Dorothy, with remainder over as to both premises to Elizabeth Canning for her life, to the heirs of the body of John Cotterell and Elizabeth Caning, and to such purposes as the said John Cotterell should by Will appoint. Signed by the mark of Dorothy Cotterell, John Cotterell, Henry Smith and John Caning. Seals of red wax, a portcullis. Witnesses: Richard Smithe and Thomas Caning. Purchased on 27 June 1928 from Mr F Guyver of Rother Street, Stratford-upon-Avon.
