Description

An Indenture quadripartite between Sir William Keyt of Ebrington, Glos., baronet of the first part, Francis Keyt of Hidcott Barthram [Hidcote Bartrim] in the Parish of Mickleton, Glos., esquire and Richard Dighton of Hidcott aforesaid, esquire of the second part, Thomas Savage of Broadway, gentleman of the third part and Walter Savage of Broadway, esquire of the fourth part, recites that the said Francis Keyt by Indentures tripartite one bearing the date the 4th and the other the date of 5th January 1687 made between the said Francis Keyt esquire and Alice Keyt, one of his daughters of the first part, Richard Dighton then of Clifford alias Clifford Chambers, Glos., esquire of the second part, the said Sir William Keyt of Ebrington, baronet and John Bailie since deceased and late of the University of Oxford, Doctor of Civil Laws of the third part, for and in consideration of a Marriage then to be had between the said Richard Dighton and the said Alice Keyt did grant to the said Sir William Keyt and John Bailie in their actual possession then being by virtue of one Indenture of Bargain and Sale dated the very next day before the day of the date of the said Indenture and of the Statute for transferring uses into possession and their heirs and assigns for ever - amongst other lands and tenements all that new erected Inclosure with the Barnes etc. belonging and all that farm and lands in Broadway in the tenure of William Paxford tenant under said Francis Keyt and all the tithes etc. and all messuages cottages tenths etc. whatsoever of the said Francis Keyt in Broadway to have and to hold said messuages etc. to the said Sir William Keyt and John Bilie and their heirs etc. for ever to the uses intents and purposes and upon the several trusts etc. hereinafter mentioned viz. the said messuage, tithes etc. in Broadway to the use of the said Sir William Keyt and John Bailie for 500 years from 29th September then last past upon trust to suffer the said Francis Keyt and his heirs to receive the rents monies and profits of the said messuage etc. until the solemnization of the said Marriage, in trust that they the said Sir William Keyt and John Bailie that they should by the sale of the premises or by making Leases thereof raise and pay the several sums following viz. to the several persons named in the schedule thereunder annexed, and that they should pay the yearly sums of £40 to Elizabeth one of the daughters of the said Francis Keyt separate and distinct from her husband as if she were a free soul for and during her natural life - also to pay £100 to place out Charles Mason son of the said Elizabeth to be an apprentice if he should attain the age of 16 - and also raise the sum of £400 to be paid to the said Charles mason if he attained the age of 23 years - and upon further trust to suffer the said Richard Dighton and his heirs etc. to enjoy all the overplus of the rents etc. of the said premises in Broadway. Now this Indenture witnesses that for the sum of £1770-15-0 paid by the said Thomas Savage to Richard Dighton in discharge of the said incumbrances mentioned and of 5/- apiece to the said Sir William Keyt by the said Walter Savage he the said Sir William Keyt at the request and by the direction of the said Richard Dighton and Francis Keyt testified by their being parties hereunto to signing and sealing hereof, at the nomination of the said Thomas Savage hath sold and confirmed to the said Walter Savage the said messuage lands etc. in Broadway for the remainder of the said 500 years subject to the trusts before mentioned and chargeable with the several sums until the same shall be paid which said sums the said Richard Dighton agrees to pay out of the said £1770-15-0 and it is declared that the said term and estate hereby assigned chargeable shall wait and attend upon the freehold and inheritance of the said messuage etc. agreed to be conveyed to the said Thomas Savage and his heirs for ever.
