Financial Settlement: Middle Hill Estate, Broadway

Description

Indenture tripartite between Cecilia Savage of Broadway, widow and relict of Walter Savage the younger late of Broadway, esquire deceased, and Executrix of his last Will, of the first part, Anne Savage of the City of Gloucester, spinster and Sarah Savage of the same place, spinster, the only sisters and heirs of the said Walter Savage, of the second part and William Savage of Broadway, doctor of physick, George Savage of the City of Gloucester, esquire and John Stephens of Broadway, gentleman (Trustees appointed by the said Walter Savage's Will for the sale of divers lands and tenements for the payment of his and his late father's debts) of the third part. Recites that Walter Savage the younger in his lifetime was seized of 2 mills called the Upper and Lower Mills, also pasturage for the load horses employed in or about the said mills in the Conygree Lane in Broadway - inclosed grounds called the Middle Hill, the Short Grove, the Short Grove pastures, the New Leasow, the Henry Acres in two parts, the Little Conygree in two parts, the Corn Crofts and long pools in five parts, aal which are in Broadway and held in Jointure by Sarah Savage the elder, mother of the said Walter the younger and the said Walter Savage the younger being so seized of the reversion of the same premises expectant upon his said mother's decease by his last Will in writing executed dated 18th January 1719 did give to the said William Savage, George Savage and John Stephens their heirs and assigns all above named property held in Jointure by the said Sarah Savage the elder in trust that the said Trustees should after the death of the said Sarah Savage the mothe4r sell the premises for the discharging of the debts as well of himself as of his late father Walter Savage the elder deceased and the overplus to be equally divided between Cecilia Savage, Anne Savage and Sarah Savage; and whereas the said Cecilia Savage has, since the death of her husband paid off the sums of money to the several creditors of her said husband mentioned in the schedule hereunto annexed amounting to £274-11-1, and whereas divers suits at law have been brought by the creditors of the said Walter Savage the elder and Walter Savage the younger, and sundry quarrels and disputes have arisen between the same parties and divers suits in Law and Equity daily threatened touching the said lands etc. - But for the ending of all suits and controversies the said Cecilia Savage, Anne and Sarah Savage have come to the following agreement. That in consideration of the sum of £274-11-1 to be paid to the said Cecilia Savage by the said Anne and Sarah Savage the sum paid by her in discharge of her husband's debts, and of the sum of £35-18-0 also paid by the said Anne and Sarah Savage she the said Cecilia will sell and release to the said Anne and Sarah Savage all her share of all and every sum or sums which she is surtitled to by the sale of the said lands etc. and all her rights and title to into or out of the same lands by virtue of the Will of the said Walter Savage the younger (agreement to that effect follows). Endorsed with acknowledgment signed by Cecilia Savage witnessed by Edward James and Geo; Jac; Berkeley that she had received upon the day of the date of the above Indenture from the within named Anne Savage and Sarah Savage the younger the sum of £310-9-0 the full consideration money within mentioned to be paid.
