Assignment of Mortgage: Middle Hill Estate, Broadway

Description

Indenture between John Howman of the City of Worcester, gentleman of the first part, Sarah Savage the elder of the City of Gloucester, widow and relict of Walter Savage the elder late of Broadway, esquire deceased and mother of Walter Savage the younger late of Broadway, esquire also deceased, Anne Savage of the City of Gloucester, spinster and Sarah Savage the younger of the City of Gloucester, spinster, the only daughters of the said Walter Savage the elder and the only sisters and heirs of the said Walter Savage the younger of the second part, Edward Cooke of Highnam, Glos, esquire of the third part, and Stephen Cooke of the Lye alias Leigh, Glos., esquire of the fourth part. Recites Deed of the 3rd October 1707 respecting a recovery of Savage Estates in Broadway; also recites Indenture dated 30th April 1713 - also that Walter Savage the younger had since died having in his lifetime only made and published his last Will dated 18th January 1719 whereby he gave the mortgaged premises to Dr. William Savage, George Savage esquire and John Stephens gentleman in trust to sell the same for discharging his debts and the debts of his father and to pay the overplus to his widow Cecilia and to Anne and Sarah Savage the younger equally divided between them - said Cecilia by Indenture dated 10th October 1721 for considerations therein mentioned conveyed to the said Anne and Sarah all her rights title and interest in the said mortgaged premises and for preventing the sale of the said mortgaged premises Sarah Savage the elder, Anne Savage and Sarah Savage the younger have borrowed of the said Edward Cooke £1500 at interest to pay off the debts of the said Walter Savage the elder and Walter Savage the younger and by Indenture quadripartite conveyed the said messuage etc. to the said John Cocks for ever to the use of Edward Cooke for 1000 years subject to proviso for making void the same upon said Sarah Savage the elder, Anne Savage and Sarah Savage the younger payment of £1500 and interest to said Edward Cooke at the days and time mentioned and after the determination of that term to the use of Sarah Savage the elder for life and on her decease to the use of Anne Savage and Sarah Savage the younger and whereas upon an assignment between John Howman and Sarah Savage the elder, Anne Savage and Sarah Savage the younger for monies due to said John Howman on 1st mortgage there remaining at date of this Indenture the sum of £360 upon the Mortgage unpaid. This Indenture witnesses that Sarah Savage the elder, Anne Savage and Sarah Savage the younger had paid the amount and he the said John Howman as far as in him lies sets over to Stephen Cooke the messuages mills etc. assigned to him said John Howman in trust for Edward Cooke until the sum of £1500 and interest be fully paid. Signed with seals (not heraldic) by John Howman, Sarah Savage, Anne Savage, Sarah Savage,Edward Cooke and Stephen Cooke.
