Description

Indentures of Lease and Release, the Release dated the 23rd March 1813 between Benjamin Smart the elder formerly of Milverton mealman, but now of Warwick, gentleman of the 1st part, William Painter of Birmingham, plater and Richard Loveday, auctioneer (Trustee for William Painter) of the 2nd part, William Whitehead of Warwick, mealman, Thomas Clark Smart of the same place, tanner and Benjamin Smart the younger of the Rock Mills, Milverton, cotton spinner (surviving Executors of Joseph Seymour in whom the term of 1000 years was vested) of the 3rd part and Josiah Barrett of Warwick, liquor merchant of the 4th part whereby Benjamin Smart the elder conveyed all those several closes or parcels of arable meadow and pasture land formerly lying dispersedly in the Common Fields of Snitterfield called Mercefield and Hungerhill Field, some time divided into eight parts containing in all 85 acres, 2 roods and 11 perches but now called Home Ground, Top Hill, Middle Hill, Marlpit Hill, Middle Ground, Far Ground, the meadow Great Hungerhill and Little Hungerhill containing (including the orchard paddock and ground on which the buildings stand or adjoining thereto) containing 87a-2r-28p and also all that messuage barn stable etc. sometime since erected and built upon part of the same premises with the garden and rickyard adjoining the above now in the occupation of Elizabeth Mills widow to William Painter and Richard Loveday (his Trustee) for £4188, also whereby William Whitehead aforesaid, Thomas Smart aforesaid and Benjamin Smart the younger aforesaid (Executors of the said Joseph Seymour) assigned the residue of the said term of 1000 years to Josiah Barrett aforesaid in trust to attend upon the inheritance in consideration of 10/-. Witnesses: Thomas Tidmas and Joseph Page. Lease dated 22nd March 1813 between Benjamin Smart the elder and Richard Loveday aforesaid of the same property for one year. Signed and sealed by Benjamin Smart senior. Witnessed as before. 'Spring Farm'.
