Description

Copy Indenture of Release between Thomas Walford of Wolverton gentleman and Elizabeth his wife of one part and Stephen Nason of Wolverton clerk and Ann his wife of the other pert whereby Thomas Walford in consideration of £400 to him paid by Stephen Nason and also in consideration of £400 to be paid to Mary Watson of Stratford-upon-Avon widow upon the assignment of a Mortgage thereinafter mentioned and also of £320 to be paid to Elizabeth Burman of Billesley widow for the assignment of a Mortgage thereinafter mentioned and also in consideration of one Annuity or yearly rent charge of £30 issuing out of land thereinafter mentioned to be granted to Thomas Walford and Elizabeth his wife and to the survivor of them for their lives and in consideration of the natural love and affection which the said Thomas Walford bore to his daughter Ann, then wife of Stephen Nason granted to Stephen Nason and his heirs a messuage in Wolverton together with the yard, garden and orchard thereto belonging and all that close called Roan's Close and three yard lands and one quarter yard land of arable meadow and pasture lying dispersedly in the Common and open fields of Wolverton then in the occupation of Seymour Walford also 4 cottages and several closes jointly in the occupations of John Creed, Joseph Morris, Robert Gibbs and William Knight together with all yards, stables, gardens, orchards etc. to hold the same to the use of Thomas Walford and Elizabeth his wife for a term of 39 years if the said Thomas Walford and Elizabeth his wife or either of them should so long live and thereafter to the use of Stephen Nason and Ann his wife and the heirs of Stephen Nason for ever. Provided that if the said Stephen Nason should pay the said Annuity of £30 to Thomas Walford and Elizabeth his wife on certain specified days, the said term of 39 years should cease and determine until default was made and that until such default the said Stephen Nason and Ann his wife should peaceably enjoy the said hereditaments subject to an Indenture of Mortgage dated 20th June 1738 made between Thomas Cookes of Aston Cantlow gentleman, John Cookes of Wolverton gentleman of the 1st part, Elizabeth Cookes of Wolverton spinster of the 2nd part and Thomas Vennor of Warwick baker of the 3rd part limiting a term of 500 years in Elizabeth Cookes and also another Indenture of Mortgage dated 9th January 1739 between Nathaniel Cookes of Stratford-upon-Avon mercer of one part and Joseph Woolmer of Stratford-upon-Avon gentleman of the other part for limiting a term of 500 years as further security for a Mortgage upon the said premises. Witnessed by Sturch Walford and Martha Pasell. Attested 20th July 1753 by Joshua Harborne and John Sproson.
