Description

Indentures of Lease and Release, the Release dated 17th August 1822 between Richard Smith of Snitterfield gentleman of the 1st part, William Wilcox of Wolverton gentleman of the 2nd part, Ann Wilcox, the wife of William Wilcox (one of the daughters of Richard smith) of the 3rd port, John Campion of Newbold Comyn gentleman and Henry Smith of Snitterfield gentleman of the 4th part and Michael Corbett of Admington, Gloucestershire esquire and Edward Townsend Higgins of Bridge Town, Alveston gentleman of the 5th part reciting that by Indentures dated 26th 27th September 1800 a messuage homestall and one yard land were conveyed to Henry Smith (father of the said Richard Smith) and reciting other Indentures dated 10th 11th May 1811 whereby the property was conveyed by Henry Smith to Richard Smith, and reciting that a marriage had recently been solemnised between William Wilcox and Ann Smith , and reciting DR 38/999, it was witnessed that for the further advancement of the said Ann Wilcox and in consideration of the agreement made prior to the said marriage also in consideration of 10/- paid by John Campion and Henry Smith, he the squad Richard Smith conveyed to the said John Campion and Henry Smith the aforesaid messuage homestall and one yard land granted to Richard Smith by the Indentures of 10th 11th May 1811, which land was more particularly described as being in a field called Armitage, all which messuage and lands were in the occupation of William Webb also another messuage and appurtenances in Wolverton and a close called the Home Close adjoining thereto containing 3 acres (theretofore divided into 3 parts of one acre each), one small part of which close was called the Hopyard, also one yard land with common of pasture for all cattle and appurtenances, also 23 poles of meadow lying in the Common Meadow of Wolverton theretofore in the tenure of Gilbert Philips and then of Matthew Taylor, also a close called Long Hays containing 8 acres theretofore in the tenure of John Windmills afterwards of Randall Prew, John Gibbs and then of Matthew Taylor, also 13 poles of meadow lying in the said Common Fields with pasture for 9 cattle and 15 sheep theretofore in the occupation of Thomas Townsend the elder afterwards of Randall Prew and John Gibbs and then of Matthew Taylor to the use of William Wilcox for life to the use of John Campion and Henry Smith during the life of William Wilcox in truest to preserve contingent remainders to the use that Ann Wilcox (nee Smith) should receive thereout an Annuity of £100 for life. To the use of Michael Corbett and Edward Townsend Higgins for a term of 200 years for the better securing of such Annuity with a proviso for cesser for such term upon fulfilment of the trusts, remainder to such uses as they the said William Ann Wilcox reach during their joint lives by deed or Will appoint, remainder to the first and other sons of the said marriage successively in tail male, remainder to daughters equally, remainder to William Wilcox and his heirs.
