Description

Agreement between Sir Ralph Bracebrugg' knight and Thomas Mallore and Margaret his wife that if the said Ralph, having enfeoffed the said Thomas and Margaret with the manor of Hurley for the term of their lives, within two years of this date was able to prove that the said manor was not held by the said Ralph in tail but in fee simple, the said Thomas and Margaret would, after taking £10 rent for each of the said two years and £20 which the said Ralph owed them, lease to the said Ralph all the said manor for the term of their lives, the said Ralph rendering annually £10; the said Thomas and Margret having the right of distraint for arrears of the said rent, and the right of re-entry for arrears of the said rent, and the right of re-entry for arrears 3 months beyond the customary terms; the said lease for their lives to be made according as the counsel of the said Thomas and Margaret advised; if, however, the said Ralph was not able or willing to prove within the said two years that the said manor was held in fee simple and not in tail, the said Thomas and Margaret granted that if the said Ralph within the said two years purchased land to the value of £20 in Warwickshire or Leicestershire not in tail or otherwise encumbered but in fee simple so that the said Thomas and Margaret would be able to have a clear rent of £10 p.a. for their two lives, to be taken at Michaelmas and Easter, that after this rent charge had been securely made over to the said Thomas and Margaret for their two lives and the said £20 debt paid to the said Thomas and Margaret, that then if the said Ralph paid them within the said two years the sum of £163. 6s. 71/4d. the said Thomas and Margaret would surrender their rights in the said manor to the said Ralph and his heirs for ever; the said Thomas and Margaret binding themselves to the said Ralph and his heirs in the penal sum of £300 to perform the same.
