Description

Indentures of Lease and Release, the Release dated the 24th March 1818 between Joseph Asterley of Shrewsbury Gent (surviving Trustee of Thomas Jellicoe, decd. (see TR46/1/6-/69) of the 1st part Thomas Sheldon of Burmington, Miller and Thomas Sheldon of Stratford-upon-Avon Grocer (devisees in trust and Executors by and of the Will of Jonathan Izod decd. See No 66/70) of 2nd part and Elizabeth Jones of Shrewsbury Spinster of 3rd part reciting No 65/69 whereby Thomas Jellicoe conveyed theretofore four cottages in Henley Street described in TR46/1/60-64 to Joseph Asterley and John Southern and reciting the sale by auction of the said cottages on the 11th April 1808 of which Jonathan Izod contracted to purchase them for £120 and also reciting the deaths of Thomas Jellicoe and John Southern in August 1813 and 1811 respectively and that no conveyance of the said cottages had been made to Jonathan Izod and Reciting the Will and Codicil of Jonathan Izod (see No 70) by which codicil the four cottages in Henley Street were ordered to be conveyed to Testators nephew William Izod of Stratford-upon-Avon, Plumber, after the death of Testators widow and reciting the death of Jonathan Izod the 10th August 1817 and the proof of the said will in the Prerogative Court of Canterbury by both the executors the 29th October 1817 and reciting that since the said auction and contract for sale the said Jonathan Izod decd. And his Executors had been in receipt of the rents and profits of the said cottages in Henley Street. It was thereby witnessed that Joseph Asterley in performance of the said contract for sale and in consideration of £114, the balance of the purchase money (which had remained unpaid) conveyed to the said Thomas Sheldon of Burmington and Thomas Sheldon of Stratford-upon-Avon the said four cottages in Henley Street (described in No60/64) upon the trusts of the said Will and Codicil of Jonathan Izod namely to pay the rents and profits to Sarah Testator's widow for her life and thereafter to convey the said cottages to William Izod and his heirs forever. Conveyed by Elizabeth Jones to produce certain title deeds. Signed Joseph Asterley, Thomas Sheldon of Burmington, Thomas Sheldon of Stratford, and Elizabeth Jones. Seals of red wax. Witnessed John Price, Scarlett Lloyd Parry and Robert Bell Wheler Solicitor. 3 membranes. Lease dated the 23rd Sept. 1818 by Joseph Asterley to Thomas Sheldon and Thomas Sheldon of same premises for one year. Signed Joseph Asterley. Seal of red wax.
