Description

Attested copies of index of lease and Release, the Release dated the 6th April 1790, whereby John Payton of Stratford-upon-Avon Gent (only son and heir at law of John Payton late of same place Innholder who died intestate) and Elizabeth his wife conveyed to Charles Pestall of Stratford-upon-Avon Surgeon, John Whateley of Chadshunt and Edward Townsend Higgins of Tiddington Gent, his equity of redemption, lands at Welcombe described in DR38/1245 and DR38/1257 together with the premises in Henley Street which were mortgaged by John Payton to Samuel Wright by TR46/1/55 and also a messuage malthouse and appurtenances in the Rother Market in the occupation of widow Keyte, also a messuage in Henley Street in the Guild Pitts in the tenures of John Cope and William Barker another messuage called the White Lion Inn with stables inc. formerly two messuages called the White Lion Inn and the Swan Inn theretofore purchased by John Payton decd. Of the Reverend. Horne and Wm. Elderton also a garden theretofore purchased by John Payton decd. Of Shakespeare Hart in the 17thC. With the buildings therein also another garden on the North side of the White Lion Inn used therewith and abutting in the Highway near the Guild Pitts, which garden was theretofore two lands of the former Common Fields of Stratford which were purchased by John Payton Decd. Of Wm. Horne, and which garden was awarded to John Payton decd. Upon inclosure, all which last mention messuage and yard were therefore in the occupation of John Payton Junior and then of William Baker also hereditaments at Knowle, Baddesley Clinton, Hockley Heath and Tanworth (more particularly therein described upon trust to sell the same for the benefit of creditors and after satisfaction of his debts c. to reserve the residue to him John Payton Covenant by John Payton and Elizabeth his wife to levy a fine of the premises to William Dester of Edstone in the Parish of Wootton Wawen Gent to ensure the use of Chas. Pestell, John Whatley and Edmund T. Higgins upon trust aforesaid. Lease dated the 8th April 1790 by John Payton to Chas Pestall, John Whatley and Edmund Townsend Higgins of same premises for a year. Witnessed to both above indentures Chas. T. Hunt, Wm. Penn and Thos. Smith. Attested 9th October 1819 by Wm. George and J. Hobbins. NB.
