Description

Two copies of the Will and Codicil of Jonathan Izod of Stratford-upon-Avon Plumbing and Glazier whereby the Testator devised and Bequeathed his seal and personal estate (except his household goods and furniture, plate, linen in the home in which he might be residing at his death which he bequeathed to his wife absolutely) to Thomas Burmington Miller who married the testators niece Mary and Thomas Sheldon of Stratford-upon-Avon Grocer who he also appointed his executors upon trust to sell, convert and invest and out of the interest theretofore pay an annuity of £13.10.00 to his sister in law Elizabeth, widow of -Bennett, but theretofore wife of his brother Richard Izod of Ullenhall decd. For her life and subject thereto pay the residue of such interest all the rents and profits of his freehold and leasehold premises to his wife Sarah for her life and after her death concerning all his freehold and leasehold property upon trust to assure; to his great nephew William Sheldon his two freehold houses with appurtenances in Sheep Street Stratford-upon-Avon in the occupation of himself Samuel Buffery also a freehold orchard in Scholars Lane in the occupation of Thomas Taylor Benjamin Green and others and also his two messuages in High Street Stratford-upon-Avon which he held by lease of the Corporation; to his great nephew Jonathan Sheldon his several freehold messuages in Church Street Stratford-upon-Avon in the occupations of Wm. Trimwell John Morris Thomas Eales and others and several messuages in Church Street adjoining the last mentioned messuages which he held by lease of the Corporation and also these four cottages in Henley Street with appurtenances in the occupations of William Warrilow John Malins, Widow Sumner and John Gibson which the testator had then contracted to purchase from the Trustees of Mr. Thomas Jellicoe and which were described in No 60 when the said Thomas Izod Sheldon, William Sheldon and Jonathan Sheldon should respectively attain 21 years, which said Thomas Izod, William and Jonathan were the sons of the said Thomas Sheldon of Burmington and May his wife (niece of Testator); and as to and concerning testators personal estate (except his household goods before referred to) upon trust to hand over and pay certain specific bequests and legacies to the said William Sheldon and others, the children of the said Thomas and May Sheldon and great nephew Joseph Sheldon ( which May and Joseph were also children of the said Thomas and May Sheldon of Burmington ) upon attaining 21 years. Also to the five daughters of Thomas Dadley decd. Also to Robert Cooper and subject theretofore to pay the residue to his said great nephew William upon attaining 21 years of age. Witnessed Elizabeth Wheler, Robert Wheler and Robert Bell Wheler. Codicil by which testator empowered his executor to carry on his trades of Plumbing and Malting which he then conducted jointly with his nephew William Izod at their discretion and during the life of his wife Sarah and the minority of his great nephew William Sheldon and the testator directed that the hereditaments at Welford should be assigned to his nephew William Izod after the death of the said Sarah and not to the said Thos. Izod Sheldon but subject to the payment by the said William to Thomas Izod Sheldon of £200 within 12 months theretofore or when the said Thomas Izod Sheldon should attain 21 years and reciting that Testator had since making his will erected 14 cottages on the orchard in Scholars Lane have directed to be assured to the said William Sheldon after the death of the said Sarah, the Testator thereby charged the two messuages in Sheep Street and the said orchard and cottages with the payment by the said William to the said Thomas Izod Sheldon of £500 upon the death of the said Sarah and upon his attaining 21 years, and Testator directed that the said four cottages in Henley Street should be assured to his said nephew William Izod instead of the said Jonathan Sheldon as directed in his will and Testator revoked legacy to the daughters of Thomas Dadley. Witnesses Edward Paine, Innholder Stratford, Edmund Paine his son and Robert Bell Wheler.
