Description

Chancery Petition of Thomas Fardon, Tredington, mealman, William Insall, Shipston, Land surveyor, William Allen, Shipston, gent., relating to the will and codicils of Thomas Edden, Tredington [copy at ER5/1225] who died 3 February 1811. All Trustees named in original will and codicils except Edward Hartwell declined to act and were replaced by new Trustees appointed by Court of Exchequer of whom Thomas Fardon, petitioner, was one and other petitioners are heirs/assigns of others. Hartwell proved will in Prerogative Court of Canterbury in January 1812 and there was clear residue of £3,000 from personal estate. Petitioners are sole surviving trustees. Death of Thomas Hartwell in October 1818. Death of Elizabeth Pettipher in 1817. Death of Ann Gibbs in 1833. Death of Mary Hartwell in 1828. Death of Thomas Edden Hartwell in 1836 intestate and without issue leaving his uncle Joseph Hartwell heir at law. Joseph Hartwell had 5 children of whom 3 survive and are with their father defendants in this case. Difficulties have arisen as to construction of will as to interest of Joseph Hartwell in copyhold and freehold estates and 3% Consols and of his eldest son George Tovey Hartwell.
