Description

Draft answer of John Gregory: that the lands in question ought to have descended to him by virtue of a marriage settlement of his father, dated 12 Elizabeth [no. DR10/1208], that his father, though only tenant for life, had made a lease of part of the entailed lands to George Marbery for 60 years, with a bond in 500 marks to observe covenants [nos. DR10/1229, 1231] that the said lease was enjoyed for 18 years after his father's death without any payment of rent, during 11 of which the plaintiff had been tenant; that the statute was never sold or assigned to the plaintiff; and that the statute had been assigned to the defendant on 15 March 1630 by the new executrix, she being no party to the suit [no. DR10/1253].
