Draft case for Opinion relating to the transfer of a copyhold: By his will, 19 December 1769, John Green devised copyhold estate to wife for life with remainder to 2 nieces Sarah and Elizabeth Green, and their heirs 25 Oct 1776 Sarah, wife of John Hobbins and Elizabeth Green each admitted to a moiety 16 Nov 1799 Thomas Beach Eades and his wife, Elizabeth, formerly Green, surrendered their 1/2 to use of Eades and heirs and at same court surrendered by way of mortgage to Richard Hemmings. 30 Oct 1800 Both Hobbins and Eades (with Hemming) surrendered their moieties to Thomas Smith who was admitted to whole. 30 Mar 1803 Thomas Smith surrendered by 1 copy before witnesses custom of manor to use of William Bartleet and heirs. 27 Oct 1803 Surrender presented to Manor Court. Bartleet has agreed to sell estate, but purchaser alleges Bartleet's title incomplete. Should surrender to Bartleet have been by 2 separate copies (one for each moiety)?
