Charles Pestell of Stratford-upon-Avon, by will dated 24 March 1805, devised two messuages in Rother Market [nos. 14-16] in trust for his wife Elizabeth Goodwin Pestell and his brother Ellis Pestell, for life, then to his nephew David Shipley Thomas and his heirs. By lease and release 30 and 31 October 1809, Thomas sold the reversionary interest to Robert Hobbes who, by agreement dated 9 November 1814, sold to Henry Roberts of Alveston. Can Mr. Roberts be compelled to complete the purchase in view of fact that obligation to pay certain legacies from property (under will of Pestell) was not expressly mentioned in agreement of November 1814?
