Description

Assignment from Joseph Smith of Stratford-upon-Avon, ironmonger, to Thomas Davis of the same, yeoman, for £39 10s 0d, of a newly erected shop and workhouse (now converted into a dwelling house) adjoining the late dwelling house of William Warry, together with a parcel of land adjoining measuring 231/2 feet long and 8 feet wide, now in the occupation of Thomas Davis; to hold the same, free from a proviso contained in an indenture of 24 December 1709 (see below): The following deeds are recited: i) 24 December 1709: mortgage from William Warry of Banbury, co. Oxon., innholder, and Joyce his wife, to Joseph Smith, of the premises described above, for 1000 years, to secure £280. ii)19 June 1716: assignment from Sir Richard Lane of Worcester, sole assignee in bankruptcy of the said William Warry (declared bankrupt on 2 May 1713), to Joseph Smith of the said premises, to hold free from the proviso for redemption.
