Description

Mortgage by lease and release from Anthony Parker of Upper Ettington [Eatington], yeoman, to Francis Findon of Shipston-upon-Stour, co. Worcs., gent., (reciting that Anthony Parker is indebted to William Weston of Butlers Marston yeoman in the sum of £200 by virtue of a mortgage of the premises first hereinafter mentioned, and reciting no. 18) in consideration of £59 18s 0d. owed by the said Anthony Parker to the said Francis Findon and for the further sum of £60 advanced by the said Francis Findon, of part of a capital messuage with malthouse and yard etc. in Upper Ettington [Eatington] late in the possession of Richard Butler [Buttler], with a little flower garden and little close called Lady Yard close or Cherry Orchard, late in the tenure of Anthony Parker, grandfather of Anthony Parker hereto, since of Robert Malins and now of Anthony Parker party hereto and William Canning; also a messuage with appurtenances and two plots of land containing together 10 acres 1 rood 18 perches in Upper Ettington [Eatington] in the tenure of the said Anthony Parker; to hold in trust that, should the said Anthony Parker not repay to the said Francis Findon £119 18s 0d. within six months, the said premises should be sold and the purchase money used to pay off the several said debts due on the same.
