Description

Assignment of leasehold property from Joseph Smith of Stratford-upon-Avon, ironmonger (the mortgagee), with the consent of William Warry of the same, tobacconist (the leaseholder), to John Elles of Stratford-upon-Avon, gentleman, and Dorothy his wife, for £138 paid to Joseph Smith and £13 1s 6d to William Warry, of two messuages, now converted into one, with orchard and garden, between Church Street and the College Ground on the north and south, now in the tenure of the said John Elles, but excepting to the said William Warry a parcel of ground, whereupon he had recently built a shop and workhouse, now in his tenure, another parcel of ground, adjoining the last, now fenced and paled in, being 231/2 feet long and 8 feet wide, and a third parcel being 58 feet long and 241/2 wide. The following deeds are recited: i) 6 July 1696: lease from Hester Jones of St. Paul's, Covent Garden (widow of Robert Jones late of Wellesbourne, clerk) and Basil Wood of St. Paul's Covent Garden (executor of the will of Robert Jones) to William Warry of Stratford-upon-Avon, tobacconist, for £101 2s 0d, of the two messuages (now one) then in the tenures of Nathaniel Roberts, alias Barefoote and Simon Godwin, and formerly of John Elles and William Bryan, alias Stephens; which messuages had been lately bought by the said Robert Jones from Dorothy Townsend, widow, Richard Morrell, baker and William Morrell, his brother, the sons of Dorothy Townsend; to hold for 2000 years at a peppercorn rent, with covenants to convert the lease into a true conveyance when the children of Robert Jones each the age of 21. ii) 9 July 1697: assignment of the said leasehold property by way of mortgage from William Warry to Joseph Smith, to secure £120.
