Appointment of Land to Uses: Stourton

Description

Appointment by Robert Fullwood the elder of Oldberrow, Worcs., Esq., of lands and premises (detailed below) to the only use of his two sons by his wife, Constance, George Fullwood and Robert Fullwood the younger, their heirs and assigns for ever. Recitals: 1) 25 and 26 March 1707 Prenuptial settlement between Constance Warkman of Stowerton [Stourton], Warks., daughter of Richard Warkman, gent., deceased, Aston Ingram of Woolford, Warks., esq., William Rogers of Shottery, gent, Henry Croft of Sutton under Brailes, Glos, gent, since deceased, Robert Fullwood of Little Alne, Esq. In consideration of the intended marriage between the said Constance and the said Robert, and of a Settlement to her made on the said Constance by the said Robert, she the said Constance, settled property on the said Richard (Ingram et al Trustees) in Trust for the said Robert during his life and after his death to the use of whichever of the children of the said Robert and Constance to be begotten, he the said Robert should appoint or limit. In absence of any such appointment, then to the use of the eldest son and his heirs male (succeeeding sons in default). If no heirs male, then to issue female and in absence of any issue, to the said Robert and his heirs forever. 2) There are 7 children of the said marriage living, 2 of whom (the said George and Robert the younger) are now of full age and therefore appointment as above. Property, moiety or undivided half of: 5 yard lands of arable and pasture in the Common Fields of Stowerton [Stourton], Infield Close (8 acres), Hyde Acre (3 acres), Meadow Close (12 acres), March Close (9 acres), Lower Cloose (1 acre), and a messuage and apputenances in Stowerton.
