Monkspath in Tanworth

Description

Arbitration award by Thomas Waryng gentleman, Nicholas Charlton of Dyrrstend' priest, Henry Ashell' and Simon Ryder, bailiff of Bordesley, in a dispute between John Archer of Tonworth' esquire and William More and Joan his wife: whereas there had been various disputes between the said parties concerning various chief rents amounting to 8s. 4d. from certain lands and tenements held by the said William in the name of the said Joan in Munkspath in the lordship of Tonworth', the said arbitrators, after examining the titles to the said property, agreed that the said John Archer had been paid the said rent of 8s. 4d. from these lands formerly belonging to William Warynges lying in Munkspath; the said Joan was heir to the said William Warynges, according to his rental and court rolls, but certain of his lands never passed to the said Joan and William More but were alienated and sold and so the original deeds of all his lands never came into their possession; however at the desire of the said arbitrators the said parties now agreed that the said William and Joan should hold the said lands and tenements and pay to the said John Archer 5s. 4d. chief rent for all the said property in Munkspath with suit of court and customary service due, provision being made that if any of the said parties or their heirs should find the original deed and how the land passed from the ancestors of the said John Archer they were to pay the chief rent named in the said deed or deeds; the said John Archer to claim no arrears for rent except for Lady Day last past, nor the said William and Joan to take any action for any trespass by the said John Archer on the said property before the making of this agreement.
