Description

Settlement previous to the marriage of Humphrey, son and heir of Richard Archer esquire, and one of the daughters of John Goodwyn' of Wynchyndon' county Bucks gentleman being a mortgage from the said Ricard Archer to the said John Goodwyn', consequent to an agreement by the said Richard for £200 that the said Humphrey should before Whitsun 1544 marry one of the daughters of the said John, by which the said Richard and Maud his wife agreed before the feast of St. James the Apostle [25 July] next to make assurance to the said John of all his lands in England and the Marches, excepting land called Botleys in the parish of Wotton Wawen county Warwyk which in the lifetime of Margaret, mother of the said Richard, were of the annual value of 20 marks, then bargained and sold to Michael Dormer, citizen and Alderman, of London; to be held to the following uses: 1) the manor of Mounspath and lands in Tonworth and lands in the occupation of ...... Barnes and William Payne of the annual value of 20 marks to be held to maintain the said Humphrey until he married one of the said daughters of the said John Goodwyn' and to marry her before the age of 18, and afterwards to be held to the use of the said Humphrey and his wife and their male heirs or in default of such issue to the right heirs of the said Richard; 2) lands of the annual value of £20 to be assured to the said Richard until the said Humphrey was 18 and married, and then to be held to the said Humphrey and his wife and his male heirs or in default as above, provided that if Maud, mother of the said Maud died before Humphrey reached 18 years then these lands were to pass to Humphrey and his wife within 6 months of her death, and lands of Maud the daughter and other lands of the said Richard of the annual value of £20 were to be assured to the said Richard and Maud for life as the jointure of the said Maud with remainder to Humphrey and his lawful heirs, or in default the inheritance of Maud was to pass to her right heirs and the lands of Richard to pass to the right heirs of Richard; 3) the remainder of the said lands to the value of £13. 6s. 8d. to be assured to the said John Goodwyn'; so that if the said Humphrey died before the said marriage, or if the said Humphrey refused to marry the said daughter, or if the said daughter refused to marry the said Humphrey, or if all the said daughters died, or if the said Humphrey died unmarried under 18 years, or if the said Humphrey and the said daughter married and died without lawful male heirs after 3 years, then if the said Richard repaid £200 within one year the property listed in No.(1) should be held to the said Richard for life with remainder to Humphrey and his lawful issue or in default to the rightful heirs of the said Richard; if the said Richard, however, refused to pay, the lands in No.(1) were to be held to the said John until he did so and the lands of the said Richard in No.(2) were to pass to Humphrey on Richard's death, to be held to the said Humphrey and his lawful issue with remainder to the rightful heirs of the said Richard, and the lands of the said Maud in No.(2) after her death were to pass to the said Humphrey and his lawful issue with remainder to the rightful heirs of the said Maud; the said Richard acknowledged that these lands were of an annual value of £100 and that before 31 May next he would hand over the said Humphrey to the said John to remain with him until he reached the age of 18 years; if the said Richard kept this agreement a bond of even date in the penal sum of £500 would be void with the provision that if the said Richard paid to the said John £200 before the said marriage the said agreement would be void.
