Description

Agreement between William Elyot of Toneworth' and Thomas Botyler of Couyntre and Thomas Whytere of Couyntre that, whereas the said Thomas and Thomas had enfeoffed the said William of the annual rent of 3 shillings to be taken from one croft called le Hethcroft in Toneworth' lying next to the grove of Henry de Sidenhal', lately belonging to Cecil' Waryng', as described more fully in the said feoffment ( no 795), if the said William was able to enjoy peaceful possession of a croft lying next to the land of Henry de Sidenhall' for ever, which he held by the gift and feoffment of the said Thomas and Thomas, the said grant of the annual rent would be void; also that if an account of a plea or default of security of the said croft, he entered the said croft and held the rent freely and in peace the the warranty in the said feoffment shall be void for ever.
