Description

Covenant to declare the uses of a feoffment with counterpart betwen Henry Brown of Toneworth' and Emma his wife, daughter and heir of Thomas Colyns, and Richard Fulwod' esquire, William Harryes, vicar of Toneworth', John Middelmore and Richard Botiller' of Sullyhull', feoffees of the said Henry and Emma, and Thomas Wescote, son and heir apparent of the said Emma, and Isabella his wife: namely that whereas the said Henry and Emma have on 4 September 7 Henry VII [1491] enfeoffed the said Richard, William, John and Richard the said feoffees of a messuage called Collyns place with meadows, leasowes and pastures in Toneworth' remaining in the keeping of the said William, the said feoffees were to hold the said property to the use of the said Henry and Emma during the lifetime of the said Emma, the said Henry and Emma having the right to occupy and use the same freely during the lifetime of the said Emma, and after the death of the said Emma, the said feoffees were to make an estate of the same to the use of the said Thomas and Isabella and their lawful issue; to hold from the chief lords of the fee for due and customary service; if the said Thomas died within the lifetime of his said mother Emma, the said feoffees, after the death of the said Emma, were to make and estate from the said property to the said Isabella for the term of her life, with remainder of the same to the rightful heirs of the said Emma; to hold from the chief lords of the fee for due and customary service.
