Draft case for the Opinion of Mr. Charles Brown as to the position and rights of the executors of Robert Bell Wheler, deceased, in re the trusts contained in the will of Henry Richardson, S/A, whitesmith, deceased, who by his will dated 7 June 1815 appointed William Chattaway and Robert Bell Wheler trustees of his real and personal estate to invest and pay income to second wife Alice Richardson for life if she willing to maintain daughters by first marriage (who are imbeciles). Provision was made for appointments of further trustees upon the death or resignation of either by the survivor, to the intent that the trusteeship should not pass to the executors or administrators of either. William Chattaway died 1850 and Robert Bell Wheler died 15 July 185(6 7) without appointing a new trustee and leaving his executors (his nephews Robert Wheler Beech and William Harrington Beech) heirs to his trusteeship.
