Appointment of Trustees: Sidenalls, Honington
Description
Indenture of Appointment dated 12 April 1790, between Theophilus Walford of the Upper Mall in the hamlet of Hammersmith, co. Middx., esq., and Agnes his wife, of the one part, and William Eaves of Stratford-upon-Avon, gent., John Preston of the same place, surgeon, and William Lord of the same place, gent., of the other part (reciting ER3/2101-2104 and that Edward Gibbs died on 30 January 1788 without male issue leaving Agnes Gibbs and Marcella Gibbs him surviving, and reciting that Theophilus Walford had become bound to William Eaves, John Preston and William Lord upon a bond for £1,000, directed to be raised by ER3/2101-2104 by Joseph Greene and William Scott for such persons as Theophilus and Agnes Walford should jointly appoint), whereby it was witnessed that the said Theophilus Walford and Agnes, his wife directed and appointed the said Joseph Greene and William Scott after the death of Agnes Gibbs to hold the sum of £1,000 (limited by ER3/2101-2104) to the use of William Eaves, John Preston and William Lord, and it was further witnessed that, for the better security of the said £1,000 so advanced, the said Theophilus Walford and Agnes his wife mortgaged all their undivided moiety in the premises called Sidenalls to William Eaves, John Preston and William Lord by demise of a term of 99 years (subject to the annuity of £30 to Marcella Gibbs) subject to a proviso for redemption. Witnesses: John Wickins, servant to Mr. Hunt, and William Barnes, servant to Mr. Walford. With copy, attested 2 September 1813, by J. W. B. Bellamy and John Snow, clerks to Messrs. Bellamy Banister, Solicitors of Shipston-on-Stour.
