Lease and Release: Nolands Farm (part), Honington

Indentures of Lease and Release dated 4 5 October 1813 (with Counterpart Release) between Charles Wyatt of Banbury, banker, and Thomas Wyatt of Hanwell, gent. (in whom the legal fee simple of the hereditaments described therein and in ER3/2087 was then vested) of the first part, John Munton of Banbury, gent., (in whom the equitable fee simple of one undivided moiety of the said premises was vested subject as to one undivided moiety of that moiety to a life interest) of the second part, Agnes Walford of Banbury, widow of Theophilus Walford (who was entitled to one undivided moiety of the hereditaments thereinafter mentioned for her life) of the third part, William Walford of Banbury, esq., Edward Gibbs Walford of the same place, clerk and Anne Walford of the same place, spinster (surviving children of William Walford of Banbury, deceased, and Frances his wife, deceased, which said William, Edward Gibbs and Anne Walford were entitled to the entirety of the premises subject as to one undivided moiety of the life interest of Agnes Walford, their aunt), of the fourth part, Gore Townsend of Honington Hall, esq. of the fifth part, William Martin Forster of Lincoln's Inn, co. Middx., gent., a trustee for Gore Townsend, of the sixth part, Hannah Howkins of Warmington, widow and residuary legatee of John Howkins, deceased, (see ER3/2111-2112) of the seventh part, Thomas Chamberlain Hughes Chamberlain late of Shennington, co. Oxon., but then of Wardington, co. Oxon., clerk and Anne, his wife, formerly Anne Snow, of the eighth part, and Thomas Lambert Snow of Tidmington, clerk and Robert Edward Hughes of Shennington, clerk of the ninth part (reciting ER3/2097-2124 and also ER3/2125-2129 and that Agnes Walford, widow of Theophilus Walford, was then living aged 70 years, and reciting that Gore Townsend had contracted with Charles and Thomas Wyatt for the absolute purchase of the hereditaments comprised in ER3/2101-2104 for £8300 but had since agreed to relinquish part of the same, i.e. 82a. 1r. 0p., to the Right Honourable Jacob Earl Radnor, the Right Honourable John Lord Eldon, the Right Honourable Thomas Windsor and the Right Honourable Henry Windsor, trustees of the marriage settlement of Thomas Townsend son of Gore Townsend, and reciting ER3/2133-2136 whereby the said 82a. 1r. 0p., being part of a total of about 176 acres, was conveyed by Charles and Thomas Wyatt to the said trustees of Thomas Townsend's settlement for £4,000) whereby it was witnessed that, in consideration of £4,300 (the residue of the said sum of £8,300) paid by Gore Townsend to the persons of the second, third and fourth parts (with the consent of the persons of the seventh, eighth and ninth parts) they, the said Charles and Thomas Wyatt (at the direction of the persons of the second, third and fourth parts and with the privity of the persons of the seventh, eighth and ninth parts) conveyed the residue of the property known as Nollands Farm more particularly therein described (see also ER3/2140) and containing 78a.3r.37p. (but not including Clerk's Leys which was retained by vendors) to Gore Townsend and his heirs to the use of such persons as Gore Townsend should by deed appoint, with remainder to the use of Gore Townsend for life with remainders over to Gore Townsend and his heirs for ever; and it was further witnessed that Hannah Howkins, in consideration of ten shillings to her paid by Gore Townsend, surrendered to him the term of 1000 years which she had as security for a mortgage in the property aforesaid, and also that Thomas Lambert Snow and Robert Edward Hughes, in consideration of ten shillings to them paid by Gore Townsend, surrendered to him the term of 1000 years which they had in the premises as security for a mortgage (at the direction of Thomas Chamberlain Hughes Chamberlain and Anne his wife). Witnesses: Thomas Kitts Walford and Samuel Breadstry, his clerk, J. W. Golby, Henry Hitchmough, Edward Banister of Shipston-on-Stour, solicitor, M. Hughes and William Chesley. With Bond, dated 5 October 1813, from William Walford the younger to Gore Townsend for £2,000 to observe covenants for title in above release.
