Indenture quadrupartite of assignment between Thomas Joleing of Alcester, co. Warwick, clerk and Susannah his wife, sole daughter and heiress of Thomas Jones late of Coughton same county, gentleman, deceased by Anne his wife, also deceased, formerly Anne Milward, of the first part, William Milward of St. Dunstans in the West, London, goldsmith, of the second part, Benjamin Milward of Wells, co. Somerset, clerk, of the third part and Thomas Rawlins of Stratford-upon-Avon, co. Warwick, esquire of the fourth part, reciting that by indenture dated 18 November 1675 between William Izard then of Welford, co. Gloucs., clerk, since deceased and Anne his wife, sole daughter of Thomas Mason then late of Welford and Margaret his wife then also deceased, and John Milward of Welford, gentleman, son and heir to the said Anne Izard by William Milward her former husband, of the one part and Anne Marshall of Loxley, spinster, of the other part, the said William Izard, Anne his wife and John Milward, in consideration of £100 paid them by Anne Marshall, demised to her the moiety of two yard land lying in the town, fields and precincts of Welford, late in the occupation of Thomas Jakeman and then of John Milward, for a term of 1000 years at a peppercorn rent, with provision for redemption on repayment of the £100 with interest on certain specified days, and reciting that, these moneys not being paid, the said Anne Marshall, after her marriage with John Williamson, citizen and haberdasher of London, by indenture dated 23 May 1678, in consideration of £100, assigned to Thomas Milward and Anne Milward the said lands for the residue of the term of 1000 years and reciting that Anne Izard since the death of William Izard, by her deed dated 14 May [probably 1680] [year omitted], in consideration that the said Thomas Milward should pay and discharge the sum of £100,£70 of this being then really due to Anne Milward, granted and conveyed these lands to him, and reciting that by indenture of mortgage dated 26 march 1681 between Thomas Milward by the name of Thomas Milward of Besford Court, co. Worcester, gentleman and Anne Milward, by the name of Anne Milward of Welford, co. Gloucs., spinster, his sister, he, Thomas, assigned to her Anne the same moiety of two yard lands for the residue of the term of 1000 years with provision for repayment of the consideration money in specified instalments on specified days, and reciting that default was made in the payment of these several sums of money whereby the estate of Anne Milward in the premises become absolute for the remainder of the term, and reciting that Anne Milward sometime after the making of this mortgage intermarried with the said Thomas Jones, and reciting that by legal wayes and means Thomas Joleing and Susannah his wife were intituled to the principal summe of £80 due on the last recited security and that by reason of default of payment the estate in law was then absolute in them of all the before recited premises for the residue of the said term, and reciting that Thomas Milward by his last will and testament dated 29 December 1699 gave and devised all these lands to William Milward, and reciting that Benjamin Milward had, for a valuable consideration, purchased from William Milward the reversion, freehold and inheritance of all the messuage and lands of Thomas Milward situate in Welford, of which the before mentioned premises were part and then witnessing that Thomas Joleing and Susannah his wife, in consideration of £80 paid them by Benjamin Milward and by direction and appointment of William Milward, and also in consideration of 5s. paid them by Thomas Rawlins, assigned to the last named by the nomination of Benjamin Milward all the said recited premises in trust for Benjamin Milward, to the end that the residue of the term of 1000 years might wait upon the freehold and inheritance, which was already conveyed to Benjamin Milward.
