Description

Indenture of Assignment between William Lord, late of Stratford-upon-Avon but then of Shipston-on-Stour, gent., (only surviving trustee and executor of the will of Henry Turbitt late of Luddington in the parish of Old Stratford, gent., deceased) of the first part, John Hathaway Turbitt of Shipston-on-Stour, esq. (only son of the said Henry Turbitt, deceased) of the second part, the Reverend William Scott late of Adderbury, co. Oxon., but then of Willersey, co. Glos., clerk (who survived his co-trustee thereinafter named) of the third part, William Walford of Banbury, co. Oxon., esq., and Frances his wife, and Theophilus Walford, late of the Upper Mall in the hamlet of Hammersmith but then of Waldershare, co. Kent, esq. and Agnes his wife of the fourth part, Anne Snow of Tidmington, co. Worcs., spinster, of the fifth part, and William Walford and Theophilus Walford of the sixth part (reciting ER3/2097-2100, ER3/2101-2104, ER3/2105-2106 ER3/2107-2108, and that William Eaves and John Preston were dead leaving William Lord their co-trustee and executor under the will of Henry Turbitt, deceased, trustees of the sums of £1000 for the benefit of John Hathaway Turbitt and reciting the deaths of Joseph Greene and Agnes Gibbs and that John Hathaway Turbitt was anxious to call in the said sum of £2,000), whereby it was witnessed that, in consideration of £2,000 paid to John Hathaway Turbitt by Anne Snow (at the request of William Scott, William Walford, Frances his wife, Theophilus Walford and Agnes his wife and with the privity of William Lord) and also in consideration of ten shillings to each of them the said William Walford, Frances his wife, Theophilus Walford and Agnes his wife and William Scott paid by Anne Snow, the said William Scott (at the direction of William Walford and Frances his wife, Theophilus Walford and Agnes his wife and with the privity of William Lord and John H. Turbitt) assigned to Anne Snow the term of 1000 years created by ER3/2101-2104 subject to a proviso for redemption by William Walford and Frances his wife or their heirs upon repayment of the £2,000 and interest; and it was further witnessed that, in consideration of ten shillings to William Lord paid by William Walford he, the said William Lord (by the direction of J. B. Turbitt) surrendered the term of 99 years in the undivided moiety in the premises called Sidenalls created by ER3/2107-2108 to William Walford to the intent that the same should merge in the freehold; and the said William Lord also surrendered the other term of 99 years in the premises called Sidenalls created by ER3/2105-2106 to Theophilus Walford to the intent that the same should merge in the freehold. Witnesses: J. B. W. Bellamy, Edward Banister, J. W. Golby, William Mould, John Munton, Thomas Ellendon, Joseph White, Margaret Lott, William Spratt and Sarah Seagrove. With attested copy.
