Indentures of Lease and Release between Charles Wyatt of Banbury, banker, and Thomas Wyatt of Hanwell, co. Oxon., gent. (trustees of the legal estate in the premises settled by ER3/2101-2104) of the first part, John Munton of Banbury, gent. (trustee of the equitable fee simple in one undivided moiety of the said hereditaments subject as to one undivided moiety of that moiety to the life interest of Agnes Walford) of the second part, Agnes Walford of Banbury, widow of Theophilus Walford, deceased, (tenant for life of one undivided moiety of an undivided moiety of the hereditaments aforesaid) of the third part, William Walford the younger, Edward Gibbs Walford, clerk, and Anne Walford, spinster, all of Banbury (surviving children of William Walford the elder, deceased, by Frances his wife, deceased, which William Walford the younger, Edward Gibbs Walford and Anne Walford were entitled to entirety of the premises settled by ER3/2101-2104 subject to the life interest of Agnes Walford in one moiety of the premises) of the fourth part, Gore Townsend of Honington Hall of the fifth part, the Right Honourable Jacob Earl of Radnor, the Right Honourable John Lord Eldon, Lord Chancellor, the Honourable Thomas Windsor of Woodside Lodge, co. Bucks., and the Honourable Henry Windsor of the Oakery, co. Kent (trustees of the marriage settlement of Thomas Townsend) of the sixth part, Hannah Howkins of Warmington (widow, executrix and residuary legatee of John Howkins, deceased) of the seventh part, Thomas Chamberlain Hughes Chamberlain of Wardington, co. Oxon., clerk and Anne his wife (formerly Anne Snow) of the eighth part and Thomas Lambert Snow of Tidmington, clerk, and Robert Edward Hughes of Shennington, co. Oxon., clerk, of the ninth part (reciting ER3/2098-ER3/2126 and that Gore Townsend had contracted to purchase part of the hereditaments mentioned in ER3/2087 called Nollands Farm containing 161a. 0r. 37p., and settled by ER3/2101-2104 for £8,300 and reciting ER3/2062-2063, being the marriage settlement of Thomas Townsend and Mary Anne Scott of which the trustees were the persons of the sixth part and reciting a power therein to the trustees to sell part of the settled land and to re-purchase other lands in or near Honington with the proceeds of sale and to hold the same upon the trusts of the settlement; and reciting that the said trustees, the persons of the sixth part, had sold Porto Bello Farm with the consent of Gore Townsend for £4,000 and reciting ER3/2132) whereby it was witnessed that, in consideration of £2,000 paid by the said trustees (persons of the sixth part) to Hannah Howkins in discharge of the mortgage described in ER3/2111-2112 (at the request of the persons of the first, second, third and fourth parts and with the privity of Gore Townsend) and in consideration of a further £2,000 paid by the trustees, persons of the sixth part, to Thomas Lambert Snow and Robert Edward Hughes in satisfaction of the mortgage assigned by ER3/2130-2131 to the said Snow and Hughes (at the request of the persons of the first, second, third and fourth parts and with the privity of Gore Townsend and Thomas C. H. Chamberlain and Anne his wife) they, the said Charles and Thomas Wyatt, (by the direction of the persons of the second, third, fourth, fifth and sixth parts and with the privity of the persons of the seventh and ninth parts) conveyed to the said trustees, persons of the sixth part, of the marriage settlement of Thomas Townsend part of the Nollands Farm containing 82a. 1r. 0p. more particularly therein described and in a letter dated 29 August 1813 (see ER3/2140/xii) upon the trusts of the settlement; and it was further witnessed that Hannah Howkins, in consideration of the premises, surrendered to the said trustees (persons of the sixth part) her mortgage term of 1000 years created by ER3/2111-2112 and the said Thomas Lambert Snow and Robert Edward Hughes surrendered to the said trustees their mortgage term of 1000 years to be extinguished in the freehold. Witnesses: Elizabeth Hiorns, William Cleaver, J.W. Golby, Edward Banister, M. Hughes, William Chesley, Henry Hitchmough, Thomas Kitts Walford and Samuel Breadstry. With : i) Bond in £2000 from Gore Townsend to the above mentioned trustees of the marriage settlement of Thomas Townsend to observe the covenants for title etc. contained in the above release; ii) Letter from Lord Eldon concerning purchase of trustees of the settlement of Thomas Townsend.
