Indentures of Lease and Release between Edward Gibbs of Stratford-upon-Avon, esq., and Agnes his wife of the first part, William Walford of Banbury, co. Oxon., gent., and Frances his wife, Theophilus Walford of Evesham, co. Worcs., gent. and Agnes his wife (which said Frances and Agnes Walford were the daughters and only two surviving children of Edward Gibbs and Agnes his wife) of the second part, Marcella Gibbs of Stratford-upon-Avon, spinster (sister of the said Edward Gibbs) of the third part, Sir Robert Keyt of Spennithorn, co. Yorks., Bart., and Crescens Carter of Tadmarton, co. Oxon., esq. of the fourth part and the Reverend Joseph Greene of Stratford-upon-Avon, clerk, and the Reverend William Scott of Adderbury, co. Oxon., clerk, of the fifth part (reciting ER3/2097-2100 and that the said Edward Gibbs and Agnes his wife were desirous of settling the premises described in ER3/2087 and ER3/2097-2100 upon their said two daughters and their issue and that the said Edward Gibbs and Agnes his wife had agreed to revoke all the uses contained in ER3/2097-2100 in consideration of settlements intended to be made by the said William and Theophilus Walford), whereby it was witnessed that Edward Gibbs and Agnes his wife revoked the uses expressed in ER3/2097-2100 and in consideration of 5 shillings to them paid by Sir Robert Keyt and Crescens Carter granted to the said Sir Robert Keyt and Crescens Carter the premises described in ER3/2087; as to and concerning hereditaments called Nollands, to the use of Edward Gibbs for life, with remainder to the use of Sir Robert Keyt and Crescens Carter to preserve contingent remainders, with remainder to the use of Agnes wife of Edward Gibbs for life, with remainder to the use of the said Joseph Greene and William Scott for a term of 1000 years upon trust to raise £2,000 to provide portions for such persons, as to £1,000, as William Walford and Frances his wife should appoint, and, as to the other £1,000, as Theophilus Walford and Agnes his wife should appoint, with remainder to the use of the first and other sons of Edward and Agnes Gibbs successively in tail male; with remainder, as to and concerning one undivided moiety of the above premises, to the use of William Walford for life, with remainder to Sir Robert Keyt and Crescens Carter to preserve contingent remainders, with remainder to the use of Frances Walford for life, with remainder to the use of such child or children of the body of Frances Walford by William Walford as the said William and Frances Walford should by deed during their joint lives appoint, with remainder in default of such appointment to the use of all the children of the said Frances and William Walford with remainders over to the use of Theophilus Walford for life, with the same remainders over to Agnes Walford for life and the children of Theophilus and Agnes Walford, with ultimate remainder to the use of the right heirs of Edward Gibbs; and, as to and concerning the other undivided moiety of the said premises, to the use of Theophilus Walford for life, with remainder to the use of Sir Robert Keyt and Crescens Carter to preserve contingent remainders, with remainder to the use of Agnes Walford for life, with remainder to the use of such child or children as the said Theophilus and Agnes Walford should during their joint lives appoint by deed, with remainder to the use of William Walford for life, with remainders over to the use of Frances Walford for life and to the children of William and Frances Walford, with ultimate remainder to the right heirs of Edward Gibbs; and, as to and concerning premises called Sidenalls, to the use of Joseph Greene and William Scott for a term of 500 years upon trust to raise a sum not exceeding £700 as Edward Gibbs should by will direct, and upon further trust to pay an annuity of £30 to Marcella Gibbs for her life and to pay the residue to such persons as should, for the time being, be entitled to the said premises called Sidewalls, with remainder to the use of Edward Gibbs for life, with remainder to the said Sir Robert Keyt and Crescens Carter to preserve contingent remainders, with remainder to the use of the first and other sons of Edward Gibbs successively in tail male; then, as concerning one undivided moiety in the premises called Sidenalls, to the use of William Walford for life with the like limitations over as to this moiety as the first moiety of the premises called Nollands is limited, with remainder to the right heirs of Edward Gibbs; and, as to and concerning the other undivided moiety in the premises (after failure of the issue of Edward Gibbs) to the use of Theophilus Walford for life with the like limitations over as to this moiety as the first moiety in the premises called Nollands is limited.
