Marriage Settlement prenuptial: Halford, Old Stratford, Welcombe and Bishopton

Articles of Agreement (with Counterpart) between Nathaniel Mason of Stratford-upon-Avon, gent., of the first part, Elizabeth Rowney of Halford, spinster, sole daughter and heir of Arthur Rowney late of Halford, gent., deceased, of the second part, Edward Townsend of Mickleton, co. Glos., gent., and Richard Bartlett of Stratford-upon-Avon, apothecary, of the third part, prior to the marriage of Nathaniel Mason and Elizabeth Rowney; whereby Elizabeth Rowney covenanted with Edward Townsend and Richard Bartlett to convey to them before 20 October next all those her hereditaments in Halford to the use of her, Elizabeth Rowney, until the solemnisation of the marriage and thereafter to the use of Nathaniel Mason for life, with remainder to the use of Elizabeth Mason for life and then to the use of such child or children of Nathaniel Mason begotten on the body of Elizabeth Rowney, as the said Elizabeth Rowney should appoint by deed or will, and in default of such appointment to the use of the first and other sons of Nathaniel Mason and Elizabeth Rowney successively in tail male, with remainder to the use of all the daughters of the said Nathaniel and Elizabeth equally; and the said Nathaniel Mason covenanted with the said Edward Townsend and Richard Bartlett to convey to them before 20 October next his one yard land and a half lying in the common fields of Old Stratford, Welcombe and Bishopton, to the use of him Nathaniel Mason for life with remainder to the use of Elizabeth Rowney for life, and then to the use of such child or children of the said Nathaniel begotten on the body of the said Elizabeth as the said Nathaniel should by deed or will appoint, and in default of appointment to the use of the first and other sons of the intended marriage successively in tail male, with remainder to the use of all the daughters of the said Nathaniel and Elizabeth equally; and the said Nathaniel Mason further covenanted with the said Edward Townsend and Richard Bartlett to lay out £2,000 in purchase of lands within ten miles of Stratford-upon-Avon within four years of the solemnisation of the marriage and to settle them upon the same trusts as the above one yard and a half land in Old Stratford.
