Description

Indenture between John Yalden of Graye's Inn in the County of Middlesex, esquire and Elizabeth his wife, late the wife and Executrix of the last Will and Testament of John Stephens late of the Middle Temple, London, gentleman deceased of the first part, Robert Constable of Graye's Inn, esquire and Roger Belwood of the Middle Temple, London, esquire of the second part, and William Thomson of the Middle Temple, London, esquire of the third part. Recites that whereas John Stephens late of Staple Inn, London, gentleman deceased by by Will dated 25th May 1658 gave to each of his younger children viz. the beforementioned John Stephens, late husband of the said Elizabeth Yalden and Mary, now the wife of the said William Thomson, the sum of £700 apiece for their portions and provided that in case his personal estate should not amount to so much deducting what afterwards in his Will was bequeathed the said portions should be raised by the sale or leasing of his grounds called Dorne Knapp grounds and a piece of new inclosed ground in Broadway - to which intent the said John Stephens the father gave the said lands to his Executors - the said John Stephens further willed that his said younger children's portions should be paid at their respective ages of 21 years or his daughter's day of marriage which should first happen he also constituted Elizabeth Stephens, widow then wife of the said John, George Townsend now of Lincolns Inn, esquire, William Livesey now of Staple Inn, esquire and Anthony Stephens of the City of London, fishmonger, Executors and afterwards on 25th May 1658 died - and whereas the said William Thomson on 17th June 1668 did marry Mary one of the said younger children, and the personal estate of the said John did not extend over and above the payment of his just debts and other legacies, and the premises not being sufficient to pay the said younger children's portions in and by Indenture Quadripartite bearing date 24th July 1672 between the said George Townsend, William Livesey, Anthony Stephens and Elizabeth Stephens widow of the first part, William Stephens of the Parish of St. Andrews, Holbourne, London esquire, eldest son and heir of the said John Stephens of the second part, the said William Thompson, Mary his wife and John Stephens the son of the thirrd part, and the said Robert Constable and Roger Belwood of the fourth part and by other conveyance for satisfaction to be made and for the settlement of the said lands in order to a sale for the raising of the said several portions the said George Townsend, William Livesey, Anthony Stephens, Elizabeth Stephens and William Stephens by and with the consent of the said William Thomson, Mary his wife and John Stephens the son did convey to the said Robert Constable and Roger Belwood the said Dorne Knapp etc. upon special trust that they should sell the lands for the raising and paying the portions aforesaid or so much thereof as the said lands would amount to or raise and whereas the said Robert and Roger have at the request of the said William Thomson and John Stephens the son, for the sum of £380 sold and conveyed the close adjoining Buckland Wood containing 26 acres to Thomas Foster the elder, gentleman and James Foster, gentleman his brother, which said sum was paid unto and equally divided between the said William Thomson and John Stephens. And whereas the said John Stephens the son by his Will dated 8th November 1677 did give to the said Elizabeth Yalden his then wife and her heirs for ever all his real estate both lands tenements and hereditaments and all his personal estate and ordained the said Elizabeth Yalden then his wife, his Executrix and soon after died and the said Elizabeth Yalden hath since proved his Will. Now this Indenture witnesseth that and in consideration of a competent sum of money to them the said John Yalden and Elizabeth his wife in hand paid by William Thomson, do grant Dorne Knapp grounds and all other lands etc. mentioned in the Will of John Stephens the father (except the close near Buckland Wood sold to Foster Brothers) to Robert Constable and Roger Belwood in Trust for the said William Thomson.
