Description

Lease from Richard Dighton of Hidcott Barthram [Hidcote Bartrim] in the Parish of Mickleton, Glos., esquire to Thomas Savage of Broadway, Worcs., gentleman. Recites that Francis Keyt of Hidcott esquire by his Indentures tripartite the one bearing the date the 4th and the other the 5th day of January 1687 made or mentioned to be made between the said Francis Keyt esquire and Alice Keyt, one of the daughters of the said Francis of the first part, the said Richard Dighton then of Clifford alias Clifford Chambers in the said County of Gloucester, esquire of the second part and Sir William Keyt of Ebrington, Glos., baronet and John Baylie (since deceased) and late of the University of Oxford Doctor of Civil Laws of the third part did grant bargain of sale and confirm to the said Sir William Keyt and John Baylie (amongst other lands) all that newly erected messuage or tenement with the barns stables and outhouses belonging and all that farm and lands in Broadway then in the occupation of William Paxford and all the tithes, tenths and other profits arising thereout and all the messuages, cottages, tenths, tithes and hereditaments of the said Francis Keyt in Broadway and all ways, fences, timber trees etc. to have and to hold for ever under several trusts and limitations viz. to raise and pay to the persons named in the schedule annexed thereto the several sums mentioned thereon with interest and £40 yearly by quarterly payments to Elizabeth on of the daughters of the said Francis Keyt for and during her natural life, and also raise the sum of £100 to place out Charles Mason, son of the said Elizabeth to be an apprentice (if he should attain the age of 16 years) and £400 to be paid to the said Charles Mason if he should attain the age of 23 years - with a proviso therein to permit the said Richard Dighton and his heirs to take the profits of the premises until default of payment should be made of the several sums mentioned and after payment thereof then in trust for the said Richard Dighton his heirs and assigns for ever - which said Annuity and money the said Richard Dighton has agreed to pay to the said Elizabeth and said Charles Mason her son as the same shall become due, and also discharge the said lands and premises in Broadway from the same and also save harmless the said Thomas Savage his heirs and Trustees from payment thereof. Now this Indenture witnesseth that for the sum of £1770-15-0 paid by the said Thomas Savage (which said sum is mentioned in other Indentures bearing equal date herewith and made between the same and other parties) viz. £1025-9-6 part thereof by direction of the said Richard Dighton unto the several persons named in the said schedule in full of their principal money and interest and the residue, viz. £745-5-6 paid to said Richard Dighton and also in performance of said agreement and for indemnifying and saving harmless the said Thomas Savage and the lands of the said Thomas Savage in Broadway from payment of same, the said Richard Dighton sets and to farm let till that ground called More Hill in the possession of John Smith and also the Hither Skyrte called Toms his ground now in possession of said Richard Dighton, and also the ground called the further Skyrt of More Hill in the possession of Mary Smith of Preston upon Stower, Glos., widow - also a meadow called More Hill meadow in the possession of the said Richard Dighton all which grounds closes and premises are in the parish of Clifford allias Clifford Chambers, Glos.: to have and to hold said grounds etc. to the said Thomas Savage from 1st May last for 500 years paying yearly to said Richard Dighton one peppercorn on the feast of St. Michael the archangel if same be demanded; provided always that if the said Richard Dighton pay the sums above named and shall save harmless the mentioned and lands by the said Thomas Savage bought from the same that then this Indenture and every Covenant shall become utterly void. Signed by Richard Dighton. Seal a shield (supported by a griffin with wings expanded) bearing a chevron between 3 griffins heads. Keyt arms. Witnesses: Edm: Perkes, Francis Phipps, Thomas Hawkins and William Hopkins. Endorsed 'Mr. Dighton's Lease of Land in Clifford to save harmless against incumbrances'. Final concord enclosed.
