Attested Copy of Demise in Trust: Court Farm, Broadway

Description

Indenture tripartite between Walter Savage of Broadway, esquire, son and heir of Walter Savage late of Broadway, esquire deceased of the first part, Thomas Oldys of Tingwick, Bucks., clerk and Cecilia Oldys, younger daughter of said Thomas Oldys of the second part and Scroggs Goad of the Inner Temple, London, esquire and George Savage of the City of Gloucester, esquire of the third part. Recites the Indentures of Lease and Release of 18th and 19th days of September 1704 (see ER3/3337 and ER3/3338) and states that whereas the said Walter Savage the elder and Walter Savage the younger are both dead and the said Walter Savage the youngest is now in possession of the said messuage, cottages, closes, lands, tenements etc. limited in and by the said recited Indentures of Release to him the said Walter Savage the youngest (party to these presents) for the term of his natural life, and whereas a Marriage is intended and agreed upon to be shortly had and solemnized between the said Walter Savage the youngest and the said Cecilia Oldys, this Indenture witnesses that the said Walter Savage for and in consideration of the said intended Marriage and the sum of £2000 paid or secured to be paid by the said Thomas Oldys as the Marriage Portion of the said Cecilia Oldys, and for making the provision of a maintenance and livelihood for the said Cecilia Oldys in case she happen to survive the said Walter Savage, in pursuance of the power in him vested by the said recited proviso in the recited Indentures of Release, and for the sum of 5/- paid to him by the said Scroggs Goad and George Savage at or before the Sealing and delivery of these presents, demises, grants and sells to the said Scroggs Goad and George Savage, their Executors etc. all that house called Broadway Court with all barns etc. etc. to hold same from and immediately after the decease of said Walter Savage for 99 years if the said Cecilia Oldys shall so long live. Upon Trust to permit the said Cecilia Oldys and her assigns from and immediately after the decease of the said Walter Savage to receive and take to her and their own proper use and benefit the rents issues etc. of the said hereby demised premises for her Jointure in satisfaction and bar of all dower or title of dower that she may claim of in unto or out of any Manors, messuages to whereof the said Walter Savage shall be seized during the coverture between him the said Walter Savage and the said Cecilia Oldys. Agreed that the said Scroggs Goad and George Savage may from time to time deduct expenses incurred in the management or execution of the said Trust. Signed Walter Savage (with seal), Thomas Oldys (with seal), Cecilia Oldys (with seal) and Scr. Goad (with seal). Witnesses: Anne Savage, William Slakes and William Clark.
