Lease: Court Farm, Broadway

Description

Indenture between Walter Savage the elder of Broadway, esquire of the one part, John Cocks of the City of Gloucester, esquire, Edmund Chamberlaine of Mangersbury, Glos., esquire and Richard Freeman of Battesford, Glos., esquire of the other part, witnessing that Walter Savage for the settling the messuages lands etc. hereafter mentioned in the name and blood of him the said Walter Savage and to and for the uses intents and purposes hereinafter limited grants to John Cocks etc. the messuage lands etc. already in their possession by virtue of a Bargain and Sale dated 13th October 1692, a house called Broadway Court with all barns stables malthouses dovehouses and out houses belonging - all those several closes or enclosed grounds viz. The Great Cuningres with the grove as now it is in three parts divided - Deanse meadow in two parts with the grove, the Sheephay and bailiff's plack - the Walkmill hay - the far Droves in two parts with the groves thereunto adjoining - Calfhey in two parts with the groves thereunto adjoining - the Langest with the grove thereunto adjoining - one ground called Pooles Close - one other ground called New Leasow grove - one ground called the Breach and grove thereunto adjoining - one ground called the Lodge with the barn therein - one ground called the Moores or by what other name or names it hath been called with the grove thereunto adjoining - one close or ground called the Suckmill Close with the poole and grove - one parcel of ground called the Shary with the Cuningree Lane - together with all tythes growing renewing or increasing of in or upon all or any of the said premises and all other his tythes in Broadway - also, cottage in the possession of Richard Walker with the garden belonging - one cottage in the possession of Thomas Moore - one cottage lately in the possession of William Muckly with the garden belonging - all which said messuages, cottages etc. are in the Town precincts or liberty of Broadway. To have and to hold to said John Cocks, Edmund Chamberlaine and Richard Freeman their heirs etc. for ever for uses viz. to the use of said Walter Savage the elder for his natural life and after his death to use of said John Cocks, Edmund Chamberlaine and Richard Freeman for 5 years upon trust to raise money out of the rents etc. to discharge the debts for which the said Walter Savage the elder is bound with Walter Savage the younger, the eldest son of the said Walter Savage the elder and also all such other debts of Walter Savage the elder and Walter Savage the younger as the said Walter Savage the elder shall by any writing signed and sealed in presence of 2 or more credible witnesses direct or appoint and from and after payment of said debts then upon trust to attend the freehold and inheritance of the said premises during the residue of said term of 5 years and after the deferment of said 5 years to the use of said Walter Savage the younger for life and after his decease to the use of said John Cocks, Edmund Chamberlaine and Richard Freeman for 21 years upon Trust to raise the sum of £600 for the youngest children of said Walter, the sum equally to be divided amongst them - the said sum being part of £1850 chargeable upon lands in Broadway by a former settlement made thereof and from and after the payment of the said £600 upon trust to attend the freehold and inheritance of the premises and the limitations thereof during the residue of said 21 years and from and after the determination of said term, to the use of Walter Savage son and heir apparent of the said Walter Savage the younger and the heirs male of his body lawfully to be begotten and for default of such issue to the use of George Savage second son of said Walter Savage the younger and the heirs male of his body lawfully etc. and for default to the 3rd, 4th, 5th, 6th, 7th, 8th, 9th and 10th and all and every other son and sons of the body of the said Walter Savage the younger lawfully etc. and the heirs males of their respective bodies lawfully issuing severally and successively one after another as they shall be in priority of birth and seniority of age the elder of such sons and the heirs male of his body being always to be preferred before the younger of such sons and for default of such issue to the use of William Savage the elder second son of the said Walter Savage the elder for his life and after his decease to the use of William Savage son and heir apparent of the said William Savage the elder and the heirs male of his body lawfully etc. and in default of such issue to the use of Walter Savage second son of the said William Savage the elder and the heirs male lawfully etc. and for default then to the 3rd, etc. 10th and every other son and sons of the body of the said William Savage the elder lawfully etc. (as before) and for default to the use of right heirs of said Walter Savage party to these presents, for ever. It is agreed that Walter, son of Walter the elder may cut and take such timber of the premises necessary for the repairing and supporting of the Mills lying in Broadway known as Broadway Mills - provided always that if the said Walter Savage the grandson shall within the space of 2 years after the decease of his father or his arrival to the age of 21 years pay or secure to the liking or approbation of the Trustees or the survivors of them the sum of £600 for the benefits of his brothers and sisters that then the said term of 21 years shall be upon trust to stand the freehold and inheritance of the premises and the limitations thereof - proviso that said Walter Savage the elder may revoke the tenor of these presents.
