Grant of land: Upton in Haselor

Description

Indenture made in the Feast of the Invention of the Holy Cross in the 14th year of Richard II [1391] between Thomas de la Morehalle and Joan, his wife of the one part and Thomas Elys of Upton juxta Haselour of the other part witnessing that if the aforesaid Thomas and Joan, his wife did not pay nor cause to be paid to the aforesaid Thomas Elys or his certain Attorney on the Feast of the Apostles Philip and James next following after the date above written or within 14 days afterwards 40 shillings in gold or silver without further delay, that from then the said Thomas and Joan would grant for themselves and their heirs that the aforesaid Thomas Elys should have and freely hold for the term of his life by the services thence owing from that fee, all that land, tenements, rents and services with appurtenances in Upton aforesaid called Marones and Purdews land paying to the aforesaid Thomas de la Marehalle and Johanne, his wife or their heirs annually at the Feast of St. John the Baptist one red rose without delay. And that if the aforesaid Thomas and Johanne, his wife should pay or cause to be paid to Thomas Elys or his Attorney on the Feast of the Apostles above within those 40 shillings of gold or silver or within 14 days afterwards without further delay that from then the aforesaid Thomas and Joan his wife should grant for themselves and their heirs that he the said Thomas Elys should have and freely hold for the term of his life now above within all that land, tenements, rents and services above named with all its appurtenances which are above mentioned paying annually to the said Thomas and Joan, his wife, their heirs and assigns 20 shillings of gold or silver at whatsoever times of the year are used, and they indeed would hold to and observe the agreement well and faithfully in witness whereof of those presents indent and writing, they had each affixed their seals in the presence of Philip Bertlett, Thomas Martyn of Bideford, William Elys, William Swyfte of Grafton and William Taylour of Dersington and others.
