Indentures Tripartite of Lease and Release, the Release dated the 1st 2nd March 1816 between Benjamin Smart the elder of the Borough of Warwick, gentleman of the 1st part, Thomas Clark Smart of the same place, tanner and Benjamin Smart the younger of the Rock Mills, Milverton, cotton spinner of the 2nd part and Josiah Barrett of Warwick aforesaid, liquor merchant of the 3rd part whereby Benjamin Smart the elder Released and assigned to the parties of the 2nd part in consideration of the natural love and affection which he bore his sons, the Mortgage for £3000 upon property described in DR38/311-312 at Snitterfield upon trust to pay the interest thereon to him during his lifetime and thereafter for the benefit of his estate. Declaration by Josiah Barrett to stand possessed of the said term of 1000 years in trust for the parties of the 2nd part until repayment of principal sum and thereafter for William Painter to attend upon the inheritance.
