Indenture Quinquapartite dated 23rd March 1820 between Joseph Barrett, shopkeeper, Walter Hill, draper and Richard Loveday, auctioneer all of the Borough of Warwick (Executors named in and appointed by the last Will and Testament of Josiah Barrett, late of the Borough of Warwick, liquor merchant, deceased of the 1st part, William Painter late of Birmingham, plater but now of Snitterfield, gentleman of the 2nd part, Thomas Clark Smart of the Borough of Warwick, tanner and Benjamin Smart of the Rock Mills in the Parish of Milverton, cotton spinner (two of the sons of Benjamin Smart the elder heretofore of Milverton, mealman but now of Warwick, gentleman, deceased and the Executors named in the last Will of the said Benjamin Smart deceased also Trustees under Indentures of Lease and Release dated 1st 2nd March 1816) of the 3rd part, Robert Philips of the Park, Prestwich, Lancashire esquire of the 4th part and John Burton Philips of Heath House in the Parish of Checkley, Staffordshire esquire of the 5th part whereby parties of the 1st part (at the request and by the direction of the parties of the 2nd 3rd parts and on the nomination of Robert Philips of the 4th part) assigned to John Burton Philips of the 5th part, the residue of a term of 1000 years created by an Indenture of Mortgage dated 17th May 1760 of property described in DR38/288-289 in trust for the said Robert Philips of the 4th part to attend upon the inheritance. Consideration of 10/- (being the residue of a term of conveyance by Mortgage of a satisfied mortgage term to the owner of the fee simple).
