Description

Indenture of Agreement between John Briscoe of Bicknell [Bickenhill], Warwickshire yeoman and Manley Ashwin late of Welcombe in the Parish of Old Stratford and then of Bidford yeoman of the 1st part, Joseph Jackson of Fulbrook and late of the Parish of Old Stratford yeoman and Sarah his wife (late Sarah Mann, and widow and sole Executrix of the late William Mann deceased) of the 2nd part and John Payton of Stratford-upon-Avon wine merchant of the 3rd part. Reciting an Indenture dated 1st January 1766 between the said Sarah then wife of Joseph Jackson of the 1st part, Joseph Jackson of the 2nd part and John Briscoe and Manley Ashwin of the 3rd part reciting the then intended marriage of Sarah theretofore widow of William Mann and Joseph Jackson, and that Joseph Jackson in consideration of the said intended marriage demised to John Briscoe and Manley Ashwin a messuage, tenement and barn with appurtenances together with certain lands lying dispersedly in the Common Fields of Norton Lindsey in the occupation of Joseph Jackson and then lately purchased by him with appurtenances, for a term of 500 years upon trust to pay an Annuity of £10 free of all deductions to the said Sarah for her Jointure and in Bar Dower, and upon further trust to secure the performance of a covenant to provide a trust fund for the benefit of the said Sarah. And reciting that the said Covenant had been performed, it was thereby witnessed that John Briscoe and Manley Ashwin at the request and direction of Joseph Jackson and Sarah his wife and in consideration of 5/- apiece to them paid by John Payton, assigned the residue of the said term of 500 years to John Payton subject to the payment of the aforesaid Annuity of £10 to Sarah Jackson and upon trust to attend upon the inheritance of Joseph Jackson.
