Description

Indentures of Lease and Release, the Release dated 5th May 1804 between William Jackson of Roomer [Rumer] Hall, Welford, Gloucestershire farmer and Elizabeth his wife of the 1st part, Samuel Jackson the younger then of Tanworth farmer and Frances his wife of the 2nd part, Charles Edward Jackson of Norton Lindsey farmer and Maria his wife of the 3rd part and Thomas Brookes of Norton Lindsey farmer of the 4th part. Reciting the Will of Joseph Jackson (see DR 38/806) whereby the Testator devised to his sons Samuel and William Jackson his Executors, the premises described in DR 38/805 subject to the payment of certain legacies and reciting that Samuel and William Jackson were theretofore seised of the said hereditaments and had agreed upon and had actually made a partition of the said hereditaments and reciting the death and Will of Samuel Jackson (see DR 38/808) whereby he devised inter alia his hereditaments at Norton Lindsey to his sons Samuel Jackson the younger and Charles Edward Jackson as tenants in common subject to payment of certain legacies and reciting that one of the three messuages mentioned in DR 38/805 had been taken down and that William Jackson was entitled to one half of the premises devised in the Will of Joseph Jackson and that the said Samuel Jackson the younger and Charles Edward Jackson were entitled to the other half and reciting that though a division of the premises had been made between Samuel Jackson the elder and William Jackson before the death of Samuel Jackson the elder, that no Deed of Partition had been made, it was witnessed that for the purpose of dividing the said hereditaments, they the said William Jackson, Samuel Jackson the younger and Charles Edward Jackson conveyed to Thomas Brookes and his heirs two messuages and certain three yard and one eighth yard lands and one sixteenth yard land lying in the Common Fields of Norton Lindsey more particularly described in Schedules Nos. 1 2 annexed, which hereditaments were those devised by Joseph Jackson. As to for and touching one of the two messuages then in the occupation of Thomas Brookes together with the lands described in Schedule No. 1 and occupied by the said Thomas Brookes to the use of the said William Jackson and his heirs and as to for and touching the other messuage and lands described in Schedule No. 2 then in the tenure of Charles Edward Jackson as to one undivided moiety in the same to the use of Samuel Jackson the elder and his heirs and as to the other undivided moiety to Charles Edward Jackson and his heirs. And William Jackson Elizabeth his wife, Samuel Jackson Frances his wife and Charles Edward Jackson Maria his wife agreed that they would before the end of the Easter Term then present levy a Fine to Thomas Brookes of the aforesaid premises which should enure to the aforesaid uses for the purpose of barring all estates tail, dower etc. Signed William Jackson, Elizabeth Jackson, Samuel Jackson, Frances Jackson, Charles Edward Jackson, Maria Jackson and Thomas Brookes. Red wax seals. Witnessed by William Tibbits, William Tibbits junior, Thomas Tidmas and Richard Wyatt. Lease dated 4th May 1804 for one year by William Jackson, Samuel Jackson and Charles Edward Jackson to Thomas Brookes of the same property. Signed William Jackson, Samuel Jackson and Charles Edward Jackson. Sealed and witnessed as before.
