Description

Indenture between the Reverend John Canning of Edgbaston Clerk in Holy Orders of the 1st part, Marianne Canning of Sherborne widow of the 2nd part, William Canning of Debden Barford farmer of 3rd part and Robert Needham Philips of Welcombe esquire M. P. of the 4th part reciting the Will of Thomas Canning (see DR 38/837) and that the legacies left by thereby had been satisfied and that John Cook Canning (one of the nephews of the Testator and Devisee of a moiety of this real property) died intestate on 18th February 1876 leaving Marianne his widow and John Canning his eldest son and heir at law and reciting DR 38/868 and that Robert Needham Philips had contracted to purchase the undivided one third moiety of John Canning (as heir at law of John Cook Canning) for £100 and the undivided two thirds moiety of William Canning (one third having been purchased by him from Samuel Canning in 1882, see DR 38/868) in the premises described in DR 38/853 DR 38/862 and the blacksmith's shop excepted from the Conveyance of December 1832 (see DR 38/835), it was witnessed that John Canning in consideration of £100 to him paid by Robert Needham Philips, William Canning in consideration of £300 to him paid by Robert Needham Philips and Marianne Canning at the direction of John Canning for the purpose of releasing her claim to dower in the undivided third moiety of John Cook Canning conveyed to Robert Needham Philips the premises described in DR 38/853 DR 38/862 together with the aforesaid blacksmith's shop.
